Applicant’s Request

The application for discharge review was received on 20030210. The Applicant requests the characterization of service received at the time of discharge be changed to honorable. The Applicant requests a documentary record discharge review. The Applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 20031205. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was four to one that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/FRAUDULENT ENTRY INTO MILITARY SERVICE, authority: MARCORSEPMAN Par. 6204.3.

“1. I would like my discharge to be changed to honorable because I feel that I did not fraudulently entered the Marine Corp. I also found out that I can not re-enlist into any services ever again because of my reentry code RE-4. I would like to be able to re-enlist soon and would like an Honorable Discharge. Also not only did my recruiter know that I was in a car accident prior to enlisting but before boot camp I told them in Receiving and also saw a doctor while in boot camp. So they knew I had a car accident prior.”

991205:  Applicant determined to be a treatment failure for back pain. Physical condition not a disability.

000125:  Applicant notified of intended recommendation for discharge under other than honorable conditions by reason of defective enlistment and induction due to a fraudulent entry into the U.S. Marine Corps.

000125:          Applicant advised of his rights and having elected not to consult with counsel certified under UCMJ Article 27B, elected to waive all rights except the right to obtain copies of the documents used to support the basis for the separation.

000125:  Commanding Officer recommended discharge under other than honorable conditions by reason of defective enlistment and induction due to a fraudulent entry into the U.S. Marine Corps. The factual basis for this recommendation was that Applicant failed to disclose during the induction process required information regarding his pre-service back injury. Had relevant facts been fully known at the time of enlistment, his eligibility for military service may have been adversely affected.

000131:  After certifying understanding of his Article 31 rights, Applicant provided voluntary statement that he did not inform anyone of the military status of his back injuries from a car accident on 970408.

000211:  SJA review determined the case sufficient in law and fact.

000215:  GCMCA [MCB, CPCA] directed the Applicant's discharge under other than honorable conditions by reason defective enlistment and induction due to a fraudulent entry into the U.S. Marine Corps.



PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 20000306 under other than honorable conditions by reason of defective enlistment and induction due to a fraudulent entry (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

Issue 1. The Board found that the service record demonstrated the Applicant’s material misrepresentation, including the omission or concealment of facts which, if known at the time would have reasonably been expected to preclude, postpone, or otherwise affect the Marine's eligibility for enlistment or induction. The documentation and statements provided by the Applicant did not overturn the presumption of regularity in this case. The Applicant’s conduct warranted separation under other than honorable conditions.
The record is devoid of evidence that the Applicant was not responsible for his conduct or that he should not be held accountable for his actions. Relief denied.

Concerning a change in reenlistment code, the NDRB has no authority to change reenlistment codes or make recommendations to permit reenlistment, reentry, or reinstatement into the Naval Service or any other branch of the Armed Forces. Neither a less than fully honorable discharge nor an unfavorable “RE” code is, in itself, a bar to reenlistment. A request for waiver is normally done only during the processing of a formal application for enlistment through a recruiter.

The Applicant is reminded that he remains eligible for a personal appearance hearing, provided an application is received at the NDRB within 15 years from the date of his discharge. Representation at a personal appearance hearing is recommended but not required.
