Applicant’s Request

The application for discharge review, received 020906, requested that the characterization of service on the discharge be changed to honorable. The Applicant requested a documentary record discharge review. The Applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 030612. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the Applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/MISCONDUCT, authority: NAVMILPERSMAN, Article 3630620.

1. To Whom, I APPRECIATE THE OPPORTUNITY TO RESPECTFULLY REQUEST THAT MY DISCHARGE BE UPGRADED TO "HONORABLE". I APPOLOGIZE TO MY GOD AND MY COUNTRY FOR BEING IMMATURE AND A VICTOM OF A CHANGING WORLD. MY CREDIBILITY OR STATUS AS EM2 UP UNTIL THE MISCONDUCT, WAS SOMEWHAT OUTSTANDING. BEING SELECTED TO THE RECRUITOR TRAINING SCHOOL IN PENSICOLA FL. DENOTES THE TYPE OF EVALS THAT WERE GAINED DURING MY FINE NAVY CAREER. THAT CAREER WAS DENTED BY A GROUP OF FRIENDS AND A NOT SO FUNNY "PRANK"! SINCE AUG. 1993 MY LIFE HAS CHANGED IN MANY WAYS. I'M MARRIED WITH TWO LOVELY DAUGHTERS AND A GREAT CAREER IN CORRECTIONS WITH A SUPER COMPANY CORRECTIONS CORPORATION OF AMERICA. MY MATURITY LEVEL TO WHERE I HAVE TO "RIGHT THE WRONG". I MUST FIRST APOLOGIZE IN THIS MANNER, TO MY COUNTRY AND TO MYSELF FOR DESTROYING A GREAT NAVY CAREER. AS LIFE CONTINUES THERE IS NOTHING I WOULD GIVE TO REPLACE THE DISCIPLINE, ADVENTURE, DIVERSITY OF FRIENDS AND MATURITY THAT I EXPERIENCED IN THE "WORLDS GREATEST NAVY". 930706:  Applicant notified of intended recommendation for discharge under other than honorable conditions by reason of misconduct due to drug abuse as evidenced by a positive urinalysis.

930707:  Applicant advised of his rights and having consulted with counsel certified under UCMJ Article 27B, elected to waive all rights except the right to obtain copies of the documents used to support the basis for the separation.

930712:  Commanding Officer recommended discharge under other than honorable conditions by reason of misconduct due to drug abuse (use).

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 930816 under other than honorable conditions for misconduct due to drug abuse (use) (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

Issue 1. There is credible evidence in the record that the Applicant used illegal drugs. Despite the positive aspects of the Applicant’s record, drug abuse warranted processing for separation, normally under other than honorable conditions. Relief denied.

The Applicant’s discharge characterization accurately reflects his service to his country.
Normally, to permit relief, an error or inequity must have existed during the period of enlistment in question. No such error or inequity occurred during the Applicant’s enlistment. Additionally, there is no law, or regulation, which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in civilian life, subsequent to leaving the service. However, the NDRB is authorized to consider outstanding post-service factors in the recharacterization of a discharge, to the extent that such matters provide a basis for a more thorough understanding of the Applicant’s performance and conduct during the period of service under review. Verifiable proof of any post-service accomplishments must be provided in order for the Applicant to claim post-service conduct and behavior as a reason to upgrade a less than Honorable discharge. Evidence of continuing educational pursuits, employment record, documentation of community service, certification of non-involvement with civil authorities and credible evidence of a substance free lifestyle, are examples of verifiable documentation that should have been provided to receive consideration for relief, based on post-service conduct. The Applicant’s evidence of post-service conduct was found not to mitigate the offense for which he was discharged. Relief not warranted.

The Applicant is reminded that he remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of his discharge. Representation at a personal appearance hearing is recommended but not required.
