Applicant’s Request

The application for discharge review, received 020228, requested that the characterization of service on the discharge be changed to honorable. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 021104. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/MISCONDUCT, authority: NAVMILPERSMAN, Article 3630620.

1. I F___ Q____ with respect ask that my other than honorable discharge be changed. I am in desperate need of my military benefits. I am unemployed, gone through a divorce and am going bankrupt. I served in the U.S. Navy from 1989 to 1993. According to my records I did admit to my wrong doing. I was the best sailor in RA-Division on the USS GEORGE WASHINGTON CVN-73. My actions cost me my position and my benefits. I was a 4.0 sailor and did the best that I could. I'm just sorry that I could not finish that way. Today Feb 11, 2002 I'm just trying to get my life together, with my layoff and divorce. I am a Jehovah's Witness and am going to get baptized soon. I've dedicated my life to god "JEHOVAH". I've been out of the service since 1993. Please, I am asking that you give me a chance. We all make mistakes. I think I have served my time. Nine years since any benefits. Please find it in your heart to change my discharge so that I can use the benefits to help me start over again. For school, a home, something please. Through out my life this is the one thing that I regret and that cost me, again forgive me please. Find it in your hearts to change my discharge please.

930517:  NJP for violation of UCMJ, Article 112a: Wrongful use of a controlled substance to wit: Marijuana on 930405.

Award: Forfeiture of $561.00 pay per month for 2 months, restriction and extra duty for 45 days, reduction to E-3. No indication of appeal in the record.

930517:  Applicant notified of intended recommendation for discharge under other than honorable conditions by reason of misconduct due to drug abuse as evidenced by your service record.

930517:  Applicant advised of his rights and having consulted with counsel certified under UCMJ Article 27B, elected to appear before an Administrative Discharge Board.

930706:  An Administrative Discharge Board, based upon a preponderance of the evidence and by unanimous vote, found that the applicant had committed misconduct due to drug abuse, that the misconduct warranted separation, and recommended discharge under other than honorable conditions.

930723:  BUPERS directed the applicant's discharge under other than honorable conditions by reason of misconduct due to drug abuse (use).


PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 930804 under other than honorable conditions for misconduct due to drug abuse (use) (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

In replying to the Applicant’s issue, the Board noted that
to permit relief, an error or injustice must have existed during the period of enlistment in question. While the Board was sympathetic to the Applicant’s situation at the time of his discharge, no such error or injustice occurred during the Applicant’s enlistment. Additionally, there is no law, or regulation, which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in civilian life, subsequent to leaving the service. However, the NDRB is authorized to consider outstanding post-service factors in the recharacterization of a discharge, to the extent that such matters provide a basis for a more thorough understanding of the Applicant’s performance and conduct during the period of service under review. Verifiable proof of any post-service accomplishments must be provided in order for the Applicant to claim post-service conduct and behavior as a reason to upgrade a less than Honorable discharge. Evidence of continuing educational pursuits, an employment record, documentation of community service, certification of non-involvement with civil authorities, are examples of verifiable documents that should have been provided to receive consideration for clemency, based on post-service conduct. While the Board noted the applicant’s comments concerning his post-service conduct, the Applicant did not provide any documentation of these activities. Relief denied.

Concerning the Applicant’s request for an upgrade so that he might receive benefits, the Board noted that the Veterans Administration determines eligibility for post-service benefits not the Navy Discharge Review Board. There is no requirement or law that grants recharacterization solely on the issue of obtaining Veterans' benefits and this issue does not serve to provide a foundation upon which the Board can grant relief. Relief denied

The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of discharge. The Applicant can provide additional documentation to support any claims of post-service accomplishments at that time. Representation at a personal appearance hearing is recommended but not required.
