Applicant’s Request

The application for discharge review, received 020618, requested that the characterization of service on the discharge be changed to honorable. The Applicant requested a documentary record discharge review. The Applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 030314. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the Applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNCHARACTERIZED/ FRAUDULENT ENTRY INTO MILITARY SERVICE, authority: NAVMILPERSMAN, Article 3630100.

1. In correspondence to Veterans Affairs acknowledgement and a review of service records for my enlistment in the Naval Command to having been released with an Honorable Discharge, I respectfully request the revision of my DD214 discharge documents to reflect the Honorable Discharge correspondingly. I respectfully request an update DD214 transcription and written notification of actions that may be taken against this motion.

I thank you for your time and give great appreciation in the conclusion of this matter.

Commanding Officer’s comments (verbatim): OSSR (Applicant) was diagnosed as possessing a personality disorder and having a preexisting chronic lower back pain. In accordance with the guidance set forth in reference (a) (MILPERSMAN 3620225), and the statement of the medical officer contained in enclosure (4), expeditious handling of separation of this member was deemed necessary. OSSR (Applicant) was treated prior to enlistment for chronic lower back pain, a condition that he failed to disclose during his inducement into the U. S. Navy as required. OSSR (Applicant) continues to experience problems and has not adapted well to military life. In light of this, I feel he has no potential for a productive career in the U. S. Navy. Consequently, OSSR (Applicant) was separated for convenience of the government on the basis of a personality disorder and defective enlistment and induction due to fraudulent entry into Naval Service.


PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 960605 with an uncharacterized service by reason of defective enlistment and induction due to fraudulent entry (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

Issue 1:
Normally, to permit relief, an error or injustice must have existed during the period of enlistment in question. No such error or injustice occurred during the Applicant’s enlistment. An uncharacterized discharge does not cast a negative light on the Applicant’s enlistment. Additionally, by regulation, members informed of discharge proceedings within the first 180 days of enlistment are given characterization of service as “Uncharacterized” unless there were unusual circumstances regarding performance of conduct which would merit an “honorable” characterization. The Applicant’s service record did not contain any unusual circumstances during his three months in the military to warrant a change of discharge to “honorable.” Relief is therefore denied.

The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of discharge. The Applicant can provide additional documentation to support any claims of post-service accomplishments at that time. Representation at a personal appearance hearing is recommended but not required.
