Applicant’s Request

The application for discharge review, received 020610, requested that the characterization of service on the discharge be changed to honorable. The Applicant requested a documentary record discharge review. The Applicant listed the Veterans of Foreign Wars as the representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 030311. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the Applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: GENERAL (UNDER HONORABLE CONDITIONS)/MISCONDUCT, authority: NAVMILPERSMAN, Article 1910-146, formerly Article 3630620.

1. Applicant indicated above requested that Veterans of Foreign Wars act as counsel concerning his application. His records were reviewed on 9/22/2002 and the following comments are hereby submitted:

The Applicant was an outstanding sailor. He had quite an accomplishment during his two and one half years of service in the Navy. He had this one unfortunate incident that caused this general discharge. He was even recommended for retention. We fully concur with his contention that his discharge be upgraded.

We refer this case to the Board for their careful and compassionate consideration and request the Applicant's discharge be reviewed for upgrading the Applicant discharge to Honorable based on equity of the action taken.

Chronological Listing of Significant Service Events :

990122:  NJP for violation of UCMJ, Article 112A: Wrongful use of controlled substance in August 1998, to wit: marijuana.
         Award: Forfeiture of 1/2 months pay for 2 months, restriction for 60 days, reduction to ATAA. No indication of appeal in the record.

990125:  Applicant notified of intended recommendation for discharge under other than honorable conditions by reason of misconduct due to drug abuse.

990125:  Applicant advised of his rights and having consulted with counsel certified under UCMJ Article 27B, elected to appear before an Administrative Discharge Board.

990201:  Medical evaluation for drug abuse found the Applicant does not meet criteria for drug abuse or dependence.

990402:  An Administrative Discharge Board, based upon a preponderance of the evidence and by unanimous vote, found that the Applicant had committed misconduct due to drug abuse, that the misconduct warranted separation, and by a vote of 2 to 1 recommended discharge general (under honorable conditions).

990428:  Commanding Officer directed the Applicant's discharge general (under honorable conditions) by reason of misconduct due to drug abuse (use). Commanding Officer’s comments (verbatim): [Airman R_ (Applicant) self-admitted to the illegal use of marijuana. In keeping with the Navy’s “zero tolerance” policy on drug abuse and the responsibility I have to ensure my squadron is guaranteed a safe working environment, I endorse the Administrative Board’s recommendation to separate Airman R_ (Applicant) from the naval service with a General discharge.]


PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 990527 general (under honorable conditions) for misconduct due to drug abuse (use) (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

Issue 1: The Applicant states his outstanding and documented letters of appreciation demonstrates his character. The Board agrees the Applicant performed well during his tenure in the Navy, but his performance prior to the drug abuse doesn’t mitigate his use of illegal drugs. Drug abuse warranted processing for separation, normally under other than honorable conditions. The discharge was proper and equitable. Relief denied.

There is no law, or regulation, which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in civilian life, subsequent to leaving the service. However, the NDRB is authorized to consider outstanding post-service factors in the recharacterization of a discharge, to the extent that such matters provide a basis for a more thorough understanding of the Applicant’s performance and conduct during the period of service under review. Verifiable proof of any post-service accomplishments must be provided in order for the Applicant to claim post-service conduct and behavior as a reason to upgrade a less than honorable discharge. E
vidence of continuing educational pursuits, a positive employment record, documentation of community service, certification of non-involvement with civil authorities and credible evidence that the Applicant is living a drug free life style, are examples of verifiable documents that should be provided to receive consideration for relief, based on post-service conduct.

The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of discharge. The Applicant can provide additional documentation to support any claims of post-service accomplishments at that time. Representation at a personal appearance hearing is recommended but not required.
