Applicant’s Request

The application for discharge review, received 020311, requested that the characterization of service on the discharge be changed to honorable. The Applicant requested a documentary record discharge review. The Applicant listed the American Legion as the representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 021115. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the Applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/Misconduct – Drug abuse (Use), authority: NAVMILPERSMAN, Article 3630620.

890629:  Drug and Alcohol Abuse Report: Marijuana abuse, less than monthly. Service directed urinalysis 890528. DAPA found Applicant not dependent and recommended Level I treatment. Physician found Applicant not dependent. Commanding Officer recommended retention and Level I treatment and written warning. Comments: Potential for future naval service is good. Recruit accession.

900302:  Medical evaluation for drug abuse found the Applicant to be drug/alcohol dependent.

900319:  Civil Conviction: South Bay Municipal Court, Chula Vista, CA for violation of battery on 15Feb90.
Sentence: Probation for 3 years under the following condition: public service for 5 days, attend Battered Women Class at YWCA, and pay fine of $75.00.

Retention Warning: Advised of deficiency (Committed one or more violations of the Uniform Code of Military Justice (UCMJ), or have been convicted of an offense by civil court), notified of corrective actions and assistance available, advised of consequences of further deficiencies, and issued discharge warning.

900509:  NJP for violation of UCMJ, Article 86: Failure to go at the time prescribed to appointed place of duty, to wit: general quarters station on 0715, 1May90.

         Award: Confinement on bread and water for 3 days. No indication of appeal in the record.

900509:  Applicant notified of intended recommendation for discharge under other than honorable conditions by reason of misconduct due to commission of a serious offense, misconduct due to civil conviction, and misconduct due to drug abuse.

900509:  Applicant advised of his rights and having consulted with counsel certified under UCMJ Article 27B, elected to waive all rights except the right to obtain copies of the documents used to support the basis for the separation and to make a statement.

900514:  Commanding Officer, USS RANGER (CV 61) recommended discharge under other than honorable conditions by reason of misconduct due to commission of a serious offense, misconduct due to civil conviction and misconduct due to drug abuse (use).

900521:  All forfeitures in excess of $25.00 for 2 months imposed at CO's NJP of 30Apr90 suspended for 3 months.

900605:  BUPERS directed the Applicant's discharge under other than honorable conditions by reason of misconduct due to drug abuse (use).

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 901017 under other than honorable conditions for misconduct due to drug abuse (use) (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

Issue 1. The Applicant’s discharge characterization accurately reflects his service to his country.
Normally, to permit relief, an error or inequity must have existed during the period of enlistment in question. No such error or inequity occurred during the Applicant’s enlistment. Additionally, there is no law, or regulation, which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in civilian life, subsequent to leaving the service. However, the NDRB is authorized to consider outstanding post-service factors in the recharacterization of a discharge, to the extent that such matters provide a basis for a more thorough understanding of the Applicant’s performance and conduct during the period of service under review. The Applicant did not provide sufficient documentation to mitigate his misconduct that fully warranted separation under other than honorable conditions. Relief denied.

The Applicant is reminded that he remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of his discharge. Representation at a personal appearance hearing is recommended but not required.
