Applicant’s Request

The application for discharge review, received 010405, requested that the characterization of service on the discharge be changed to general/under honorable conditions. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 011018. After a thorough review of the records, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/ Misconduct – Drug abuse (Use), authority: NAVMILPERSMAN, Article 3630620.

PART III – RATIONALE FOR DECISION AND PERTINENT
REGULATION/LAW

Discussion

The applicant was discharged on 910827 under other than honorable conditions for misconduct due to drug abuse (use) (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

In response to the applicant’s issue, the Board found nothing in the records nor did the applicant submit any supporting documentation that shows that the applicant completed any drug rehabilitative treatment or proof that he is no longer using drugs. Additionally, there is no record of any problem(s) that the applicant experienced which resulted from his military service. The Board will not grant relief on the basis of this issue.

The following is provided for the applicant’s edification. There is no law or regulation which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in the civilian life subsequent to leaving the service. Normally, to permit relief, an error or injustice must have existed during the period of enlistment in question. No such error was discovered in this case. The NDRB is authorized to consider post-service factors in the recharacterization of a discharge (D), to the extent that such matters provide a basis for a more thorough understanding of the applicant’s performance and conduct during the period of service under review. Examples of these factors include, but are not limited to, continuing education, voluntary community service, proof of not using illegal drugs or drug rehabilitation, record of employment and proof of non-involvement with civil authorities. The applicant did not provide any post-service documentation for the Board to consider. The applicant
is reminded that he remains eligible for a personal appearance hearing provided an application is received at the NDRB within 15 years from the date of his discharge. Representation at personal appearance hearing is highly recommended but not required.
