Applicant’s Request
The application for discharge review, received 020820, requested that the characterization of service on the discharge be changed to honorable. The Applicant requested a documentary record discharge review. The Applicant did not list any representative on the DD Form 293.

Decision

A documentary discharge review was conducted in Washington, D.C. on 030602. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the Applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/MISCONDUCT, authority: MARCORSEPMAN 6210.5.

PART I - APPLICANT’S ISSUES AND DOCUMENTATION

1. I FEEL THAT MY DISCHARGE WAS UNFAIR DUE TO THE FACT IT WAS BASED ON ONE INCIDENT OVER A 15 MONTH PERIOD. UP TO THE POINT OF THE INCIDENT I HAD EXCELLENT FITNESS REPORTS AND THOROUGHLY ENJOYED MY TIME IN THE MARINE CORPS. I CANNOT DESCRIBE HOW BADLY I FEEL BECAUSE OF THE STUPIDITY OF THE INCIDENT. I AM REQUESTING THAT IT BE CHANGED TO A HONORABLE. SINCE MY DISCHARGE I HAVE WORKED FULL TIME AND AM NOW GOING TO SCHOOL FULL TIME WITH THE SUPPORT OF MY PARENTS..

990824:  NAVDRUGLAB, San Diego, CA, reported Applicant’s urine sample, received 990818, tested positive for cocaine.

 991216:  NJP for violation of UCMJ, Article 92:
 Specification: Violate ALMAR 106/98, BEQ Policy on 991214.
Awarded forfeiture of $210.00 per month for 1 month, restriction and extra duties for 14 days. Forfeiture, restriction and extra duty suspended for 6 months. Not appealed.
991216:  Counseled for deficiencies in performance and conduct. [Misconduct as evidenced by recent office hours.] Necessary corrective actions explained, sources of assistance provided, disciplinary and discharge warning issued.
000120:  Applicant refused medical officer’s evaluation for drug addiction.

 000217:  Summary Court-Martial.
         Charge I: violation of the UCMJ, Article 112a (1 Spec): Wrongfully use or possession of illegal substance.
         Finding: to Charge I and the specification thereunder, guilty.
         Sentence: Forfeiture of $670.00, restriction for 60 days, reduction to Pvt.
         CA action 000217: Sentence approved and ordered executed.

000306:  Applicant notified of intended recommendation for discharge under other than honorable conditions by reason of misconduct due to drug abuse.
000306:  Applicant advised of his rights and having elected not to consult with counsel certified under UCMJ Article 27B, elected to waive all rights except the right to obtain copies of the documents used to support the basis for the separation.

000317:  Commanding Officer recommended discharge under other than honorable conditions by reason of misconduct due to drug abuse. The factual basis for this recommendation was Applicant’s use of cocaine.

000322:  SJA review determined the case sufficient in law and fact.

000328:  GCMCA [Commanding General, 1 st Marine Division (Rein)] directed the Applicant's discharge under other than honorable conditions by reason of misconduct due to drug abuse.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 000331 under other than honorable conditions for misconduct due to drug abuse (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

 Issue 1. There is credible evidence in the record that the Applicant used illegal drugs. Drug abuse warranted processing for separation, normally under other than honorable conditions. The discharge was proper and equitable. Relief denied.

 The Applicant’s discharge characterization accurately reflects his service to his country. Normally, to permit relief, an error or inequity must have existed during the period of enlistment in question. No such error or inequity is evident during the Applicant’s enlistment. Additionally, there is no law, or regulation, which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in civilian life, subsequent to leaving the service. Relief not warranted.

The Applicant is reminded that he remains eligible for a personal appearance hearing, provided an application is received at the NDRB within 15 years from the date of his discharge. Representation at a personal appearance hearing is recommended but not required.
