Applicant’s Request

The application for discharge review, received 020509, requested that the characterization of service on the discharge be changed to honorable. The Applicant requested a personal appearance hearing before the board in the Washington National Capital Region. The Applicant listed a civilian counsel as the representative on the DD Form 293.


Decision

A personal appearance discharge review hearing was conducted in Washington, D.C. on 030331. After a thorough review of the testimony, records, supporting documents, facts and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the Applicant’s service at the time of discharge. However, after consideration of the Applicant’s substantial post-service accomplishments, good citizenship, and military record, the Board determined that partial relief was warranted on the basis of clemency. The Board’s vote was unanimous that the character and narrative reason of the discharge shall change. The discharge shall change to: UNDER HONORABLE CONDITIONS (GENERAL)/SECRETARIAL AUTHORITY, authority: MARCORSEPMAN Par. 6214.


A personal appearance discharge review was conducted in Washington, D.C. on XXXXXX. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the Applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. Whether the NDRB should grant clemency to Applicant based upon his full acceptance of culpability for his past actions, post-service factors indicating his full rehabilitation, his quality of service and lack of aggravating circumstances.

Whether the clemency granted by the NDRB should include the recharacterization of the discharge of Applicant to that of Honorable.

Reconsideration is appropriate in this case and the standard of review should be
de novo.

         Specification 1: Failure to obey Marine Corps Base Order 5500.1C, by wrongfully
possessing 5 pairs of nunchakus, two pair of sai's, two pairs of tonfa's, four throwing stars, and one retractable night stick.
         Specification 2: Failure to obey Marine Corps Base order 5500.1C by failing to register 20 assorted knives, all with a blade longer than 6 centimeters, 9 blow darts with blow gun, 4 samurai swords, 1 oar and 2 staff poles, 1 wooden staff pole with a metal hooking device on the end, 1 tri-staff, 1 knife buckle, and 1 brown handled sword.
Charge II: violation of the UCMJ, Article 121:
Specification: Between 1 and 23 Oct 86, stole various items, property of the U.S. Government, of a value of about $146.21.
         Findings: to Charge I and II and specifications thereunder, guilty.
         Sentence: Forfeiture of $200.00 pay per month for 2 months, confinement for 60 days, reduction to Pvt, and a bad conduct discharge.
         CA 870518: Sentence approved and ordered executed except for the BCD.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 890303 with a bad conduct discharge which was the sentence
adjudged by a properly constituted special court-martial that was determined to be legal and proper, affirmed by appellate review authority and executed (A and (B). The Board presumed regularity in the conduct of governmental affairs (C). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable at the time issued (D and E).

Issue 1. The Board found that the Applicant’s post-service conduct was sufficiently creditable to warrant an upgrade of his characterization of service to under honorable conditions (general). The Applicant’s career progression, strong references, educational achievements, and awards demonstrated that the Applicant possessed character and drive that was not always evident during his final tour of active duty. A court-martial may not adjudge an administrative separation (such as a discharge under honorable conditions) as punishment. Therefore, the Board found that the applicant’s narrative reason for separation should be changed to Secretarial Authority to support administrative details regarding his upgraded characterization of service. However, the Board found that the Applicant’s post-service conduct does not sufficiently mitigate his misconduct while on active duty to warrant full relief in the form of an honorable discharge. Therefore partial relief is granted.

A. Paragraph 1105, DISCHARGE ADJUDGED BY SENTENCE OF COURTS-MARTIAL, of the Marine Corps Separation and Retirement Manual, (MCO P1900.16C), effective 821001 until 890626.

B. The Manual for Courts-Martial authorizes the award of a punitive discharge if adjudged as part of the sentence upon conviction by a special or general court-martial for violation of the UCMJ, Article 92, failure to obey a lawful general order, and Article 121, larceny.
