Applicant’s Request

The application for discharge review, received 020424, requested that the characterization of service on the discharge be changed to honorable or general (under honorable condi-tions) and the reason for the discharge be changed to convenience of the government. The Applicant requested a documentary record discharge review. The Applicant listed American Legion as his representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 030410. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the Applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: BAD CONDUCT DISCHARGE/COURT-MARTIAL, authority: MARCORSEPMAN Par. 1105.

990119:  Special Court-Martial.
         Charge I: violation of the UCMJ Article 86:
         Specification 1: Did, on or about 980918, without authority, absent himself from his unit, until apprehended on or about 981212 (85 days/A).
         Findings: to Charge I and specification 1 thereunder, guilty.
         Sentence: Confinement for 50 days, forfeiture of $639.00 pay per month for 1 month, and a bad conduct discharge.
         CA 990315: Sentence approved and ordered executed except for the bad conduct discharge, but execution of that portion of the sentence adjudging to confinement in excess of time served is suspended for a period of twelve months from the date of this action, at which time, unless sooner vacated, the suspended portion of the sentence will be remitted without further action.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 000121 with a bad conduct discharge which was the sentence adjudged by a properly constituted special court-martial that was determined to be legal and proper, affirmed by appellate review authority, and executed (A and B). The Board presumed regularity in the conduct of governmental affairs (C). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (D and E).

Issue 1: The Applicant, through counsel, contends that aspects of his post-service conduct, to include continued education, employment, and stable family life should be considered in the recharacterization of his discharge. The NDRB is authorized to consider post-service factors in the recharacterization of a discharge even though there is no law or regulation that provides for an unfavorable discharge to be upgraded based solely on the passage of time or good conduct in the civilian life subsequent to leaving the service. Outstanding post-service conduct, to the extent that such matters provide a basis for a more thorough understanding of the Applicant's performance and conduct during the period of service under review may be considered. Verifiable proof of post-service accomplishments must be provided in order for the Applicant to claim post-service conduct and behavior as a reason to upgrade a less than honorable discharge. E
vidence of continuing educational pursuits, an employment record, documentation of community service, and certification of non-involvement with civil authorities are examples of documents that may be provided to the Board to receive consideration of relief based on post-service conduct. The Board deemed the documentation provided by the Applicant as not sufficient for the Board to consider an upgrade of the characterization of discharge. Relief on this basis is denied.

The Applicant is reminded that he remains eligible for a personal appearance hearing, provided an application is received at the NDRB within 15 years from the date of his discharge. Representation at a personal appearance hearing is recommended but not required.

A. Paragraph 1105, DISCHARGE ADJUDGED BY SENTENCE OF COURT-MARTIAL , of the Marine Corps Separation and Retirement Manual, (MCO P1900.16E), effective 950818 until present.

B. The Manual for Courts-Martial authorizes the award of a punitive discharge if adjudged as part of the sentence upon conviction by a special or general court-martial for violation of the UCMJ Article 86, Absence without leave (more than 30 days).
