Applicant’s Request
The application for discharge review, received 010723, requested that the characterization of service on the discharge be changed to honorable or general/under honorable conditions. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.

Decision

A documentary discharge review was conducted in Washington, D.C. on 020130. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/Misconduct – commission of a serious offense, authority: NAVMILPERSMAN, Article 3630600.

Issues

 1. My discharge was inequitable because my discharge was given to me on alcohol backed incidents. At this time I needed a treatment program for alcohol abuse. I was given CAAC program but I was 19 years of age and I felt I was convinced by navy administrators to accept a OTH Discharge. I was not pressed to complete a program before my discharge and now I need treatment for alcohol and drug and I can't receive it. I hope the board takes in to account of age and I never can remember any abuse until military entry.

900927:  You are being retained in the Naval service, despite your defective enlistment and induction due to fraudulent entry into naval service as evidenced by your failure to disclose your pre-service civil involvement: Jul 90, Disregarding traffic red light, Birmingham, AL, $54.00 UNPAID.
910220:  NJP for violation of UCMJ, Article128: (Simple Assault) - about 2155, 910210 unlawfully strike DC3 H______, violation of UCMJ Article 134: (CA BUS & PROF CODE SEC 25662), about 910210 wrongfully consumed alcoholic beverages while under the age of 21, violation of UCMJ Article 92: (Failure to obey lawful order or written order) having knowledge of a lawful order, did fail to obey the same by wrongfully consuming alcohol while underage, violation of UCMJ Article 134: Did wrongfully consume alcoholic beverage while being under the age of 21 years, and under the circumstances was of a nature to bring discredit upon the Armed Forces.
         Award: Forfeiture of $100.00 per month for 1 month, restriction to TPU for 14 days, and to attend CAAC. No indication of appeal in the record.
910424:  NJP for violation of UCMJ, Article 128: (Simple Assault) - did at NAVSTA BEQ #452 TI CA on or about 2200, 910413, unlawfully pushed AN R____ C. P____, violation of UCMJ Article 92: (Failure to obey lawful written order or regulation) - did on or about 2200, 910413 fail to obey by being in an area designated off limits.
         Award: Forfeiture of $200.00 pay per month for 1 month, restriction to TPU for 3 days. No indication of appeal in the record.
910426:  Applicant notified of intended recommendation for discharge under other than honorable conditions by reason of misconduct due to the commission of a serious offense as evidenced by all punishments during your current enlistment for which a punitive discharge could have been awarded.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 910630 under other than honorable conditions for misconduct due to commission of a serious offense (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).
Issue 1. The Board found that the applicant’s age, education level, and test scores qualified him for enlistment. While he may feel that consumption of alcohol and youth were factors that contributed to his actions, the record clearly reflects his willful disregard for the requirements of military discipline and demonstrated that he was unfit for further service. On 910426, the applicant was advised of his rights and having elected not to consult with counsel certified under UCMJ Article 27B, elected to waive all rights except the right to obtain copies of the documents used to support the basis for the separation. On 910502, the applicant declined in-patient treatment at a VA Hospital. The record is devoid of evidence that the applicant was not responsible for his conduct or that he should not be held accountable for his actions. Relief denied.
The applicant’s discharge characterization accurately reflects his service to his country. The discharge was proper and equitable. Normally, to permit relief, an error or injustice must have existed during the period of enlistment in question. No such error or injustice occurred during the applicant’s enlistment. Additionally, there is no law, or regulation, which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in civilian life, subsequent to leaving the service. The applicant is reminded that he remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of his discharge. The applicant can provide additional documentation to support any claims of post-service accomplishments at that time. Legal representation at a personal appearance hearing is highly recommended but not required. Relief denied.
