Applicant’s Request

The application for discharge review, received 010327, requested that the characterization of service on the discharge be changed to general/under honorable conditions. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 010817. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/MISCONDUCT, authority: NAVMILPERSMAN, Article 3630620.

1. MY UNDESIRABLE DISCHARGE WAS INEQUITABLE BECAUSE IT WAS BASED SOLEY ON ONE ISOLATED INCIDENT IN 9 1/2YEARS OF MILITARY SERVICE. I HAVE SINCE CONTINUED A CAREER IN THE COMMUNICATIONS FIELD AND AM EXCELLING WELL. I HAVE BEEN A MODEL CITIZEN IN THE CIVILIAN SECTOR SINCE BEING RELEASED FROM MILITARY SERVICE. I AM REQUESTING A REVIEW OF MY DISCHARGE BECAUSE ONE ISOLATED INCIDENT DOES NOT DEFINE THE PERSON THAT I REALLY AM OR THE PERSON THAT I WAS AT THE TIME OF THE INCIDENT. MY MILITARY RECORD WILL SHOW THAT BEFORE THE INCIDENT I WAS A MODEL SAILOR. SOME OF MY ACHIEVEMENTS WHILE SERVING IN THE NAVY WERE THE NAVY ENLISTED SURFACE WARFARE SPECIALIST, NAVY ACHIEVEMENT MEDAL, ATTAINING THE RANK OF E6, LPO OF AN AEGIS CLASSS DESTROYER, DEVELOPMENT AND TRAINING OF LESSON PLANS FOR THE COMMISSION OF USS BARRY'S ANDA HOST OF OTHER AWARDS AND MEDALS. I WOULD GREATLY APPRECIATE IT IF THE BOARD WOULD TAKE ANOTHER LOOK AT MY RECORD AND CONSIDER UPGRADING MY DISCHARGE TO A GENERAL UNDER HONORABLE CONDITIONS.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 950508 under other than honorable conditions for misconduct due to drug abuse (use) (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

The applicant’s issue states that his discharge was inequitable as it was based on an isolated incident and post service accomplishments. The Board found no permissive drug policy to exist where a service member is permitted to use drugs. The applicant’s rank and level of responsibility further contributed to the characterization of service. Relief is denied.

The NDRB is authorized to consider post-service factors in the re characterization of a discharge. There is no law or regulation which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in the civilian life subsequent to leaving the service. Normally, to permit relief, an error or injustice must have been found to have existed during the period of enlistment in question. Outstanding post-service conduct, to the extent that such matters provide a basis for a more thorough understanding of the applicant’s performance and conduct during the period of service under review, may be considered by the NDRB. The applicant failed to provide documentary evidence to demonstrate his sobriety, positive community service, employment history, and clean police record. Relief is not warranted.

The applicant is eligible for a personal appearance hearing provided the application is received within 15 years from the date of discharge. Representation at personal appearance hearing is recommended .
