Applicant’s Request

The application for discharge review, received 010309, requested that the characterization of service on the discharge be changed to honorable. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 010907. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety but found inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the discharge shall change to: HONORABLE/WEIGHT CONTROL FAILURE, authority: NAVMILPERSMAN, Article 3620260.

1. I would like to have my discharge upgraded, so I can go to school for Pusco County Corrections. Currently they will not let anyone enroll with a military record, that state's anything but a honorable discharge will not be a candidate for a position with the sheriffs office.

960308:  Applicant advised of his rights and having elected not to consult with counsel certified under UCMJ Article 27B, elected to waive all rights.

960314:  Commanding officer directed discharge with general (under honorable conditions) by reason of weight control failure due to not meeting the prescribed physical readiness standards.

960320:  Member was interviewed this date in accordance with MILPERSMAN 3620220 and the provisions of voluntary separation under this Article were explained to the member. Member desires to separate and has been issued the reenlistment code RE-3T, recommended for reenlistment, but disqualified due to weight control failure.


PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 960401 general (under honorable conditions) for weight control failure (failed to meet the minimum prescribed physical readiness (PRT) standards (A and B). The Board presumed regularity in the conduct of governmental affairs (C). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper but not equitable (D and E). In accordance with NAVMILPERSMAN Article 3620260, separation of enlisted personnel for weight control failure should be characterized as Honorable unless a General discharge is warranted. The member’s performance evaluation record is the bases for determining whether a General discharge is warranted. The applicant’s service record was void of any documented misconduct, throughout his entire enlistment, and his performance marks rated an Honorable discharge (3.73 in performance, 3.93 in behavior and 3.87 overall trait average). The applicant’s discharge shall be changed to Honorable. Relief granted.
