Applicant’s Request
The application for discharge review, received 010205, requested that the characterization of service on the discharge be changed to honorable. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.

Decision

A documentary discharge review was conducted in Washington, D.C. on 010615. After a thorough review of the records, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: GENERAL UNDER HONORABLE CONDITIONS/MISCONDUCT, authority: NAVMILPERSMAN, Article 1910 - 142 (formerly 3630605).

D_____ to report to the Naval Station Rota Hospital, NLT 1600, on 990728 in order to begin the Anthrax Vaccination Immunization Program as part of your assignment to a Direct Support Operation billet. Member refused to sign.

990924:  Retention Warning: Advised of deficiency (On or about 1600, 990909 you have failed to report to the Naval Station, Rota Hospital to begin the required Anthrax Vaccination program as ordered by CTRCS P___ R____ in accordance with DOD and Navy policy. This order is a requirement for all assigned personnel in a Direct Support Operation billet. Your actions are in Violation of the Uniform Code of Military Justice, Article 92 (failure to obey order or regulation), notified of corrective actions and assistance available, advised of consequences of further deficiencies, and issued discharge warning.

PART III – RATIONALE FOR DECISION AND PERTINENT
REGULATION/LAW

Discussion

The applicant was discharged on 991123 general under honorable conditions for misconduct due to commission of a serious offense (A and B). The Board presumed regularity in the conduct of governmental affairs (C). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (D and E).

In response to the applicant’s issues, the Board found that the applicant had an excellent service record and noted the fact that the applicant was accepted to Officer Candidate School. However, there has been no official change in policy by the Navy, or higher authority, made expressly retroactive to the type of discharge received by the applicant. Until there is an official change to the current anthrax vaccination policy, the Board cannot grant the applicant relief concerning his issues. If there is an official change to the anthrax vaccination policy, the applicant will be notified and his case will be re-opened and reviewed again.
