Applicant’s Request

The application for discharge review, received 010702, requested that the characterization of service on the discharge be changed to honorable or general/under honorable conditions or entry level separation or uncharacterized. The applicant requested a personal appearance hearing in the Washington National Capital Region. The applicant did not list any representative on the DD Form 293. Subsequent to the application, the applicant obtained representation from the American Legion.

Decision

A personal appearance discharge review hearing was conducted in Washington, D.C. on 020312. After a thorough review of the testimony, records, supporting documents, facts and circumstances unique to this case, NDRB discerned no impropriety but did discern an inequity in the characterization of the applicant’s service. The Board’s vote was three to two that the character of the discharge shall change. The discharge shall change to: UNDER HONORABLE CONDITIONS (GENERAL)/ Failure to Participate (Reserve not on active duty)(administrative discharge board required but waived); authority: MARCORSEPMAN 6213.

A personal appearance discharge review was conducted in Washington, D.C. on 02XXXX. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/Failure to Participate (Reserve not on active duty) (administrative discharge board required but waived), authority: MARCORSEPMAN 6213.

If appropriate add the following:
The NDRB did note an administrative error on the original DD Form 214. Block 28, Narrative Reason for Separation should read: “_____________” vice “__________”. The original DD Form 214 should be corrected or reissued as appropriate.

[The failure to acknowledge official certified mail constitutes acknowledgement and waiver of all rights (MARCORSEPMAN par. 6303)].

920303:  Commanding officer recommended discharge under other than honorable conditions by reason of misconduct due to unsatisfactory participation in the Ready Reserve. The factual basis for this recommendation was missing scheduled drills on 15-17Nov91 (5) and 10-12Jan92 (5).

920325:  SJA review determined the case sufficient in law and fact.

920331:  GCMCA [Commanding General, 4
th Marine Division (Rein)] directed the applicant's discharge under conditions other than honorable by reason of misconduct due to unsatisfactory participation in the Ready Reserve.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 920410 under other than honorable conditions for misconduct due to unsatisfactory participation in the Ready Reserve (A, B, and C). The Board presumed regularity in the conduct of governmental affairs (D). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper but not equitable (E and F).

Issues 1. The applicant states, there were extenuating circumstances that contributed to his missed drills. The applicant’s medical records show he sustained a right knee anterior cruciate ligament tear (ACL) on 11/5/91, which required surgery and extensive rehabilitation through 9/15/92. The Board noted the applicant was aware of the procedures to properly notify his reserve unit of his medical condition and to request permission to be excused from drills, as documented by his previous excused drills for medical reasons. However, there is no documentary evidence to show that the applicant executed these procedures prior to missing the reserve drills resulting in his discharge. The Board determined that the applicant’s testimony was compelling enough to demonstrate that he attempted to contact his unit to notify them of his medical condition and request permission to miss upcoming drills. It was the applicant’s responsibility to follow up on his attempts to provide medical documents of his injuries to his unit, which he failed to do. The Board determined there were mitigating circumstances that contributed to the applicant’s missed drills and therefore will grant relief in the form of an upgrade of the discharge characterization to under Honorable conditions (General). The Board will not upgrade the applicant’s discharge to Honorable as a result of his failure to maintain proper communications with his Selected Marine Corps Reserve Unit. Partial relief is therefore granted.

Issue 2. The applicant cites his post-service performance and conduct as the basis for requesting an upgrade to his discharge. The Board determined the applicant’s post-service performance and conduct was insufficient to warrant an upgrade to his discharge characterization. Relief based on this issue is denied.
