Applicant’s Request

The application for discharge review, received 001228, requested that the characterization of service on the discharge be changed to general/under honorable conditions. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.

Decision

A documentary discharge review was conducted in Washington, D.C. on 010808. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/MISCONDUCT, authority: MARCORSEPMAN 6210.5.

1. Dear Sirs,

I'm writing to request my military discharge status be changed to General Under Honorable Conditions. At the time of my discharge I was a very young man with little ambition, and very irresponsable. Since that time I have happily married, and my wife and I have a 1 year old son. We are active members of our local church, where we serve on the youth committee and volunteer for various marriage & family enrichment programs. As I look towards my familys future I am reminded of my early mistakes, and sincerily wish to rectify any areas within possibility. It is important to me to be able to set an example to my son that he would want to follow. I have been drug free for three years. I am a contract carpet/flooring installer. My wife is a registered nurse, we live in a small rural town where family and home come first. Please consider my request to change my discharge status. I feel I have become a better man than I was at age 19. Thank you very much for your time and attention to this matter. Sincerily

Chronological Listing of Significant Service Events :

941108:  Applicant briefed upon and certified understanding of Marine Corps policy concerning illegal use of drugs.

951206:  Medical evaluation for drug abuse found the applicant to be a drug abuser, not drug dependent.

951212:  Substance Abuse Counseling Center evaluated applicant and found him to be a drug abuser.

960215:  NJP for violation of UCMJ, Article 112A:
Specification: Wrongfully use methamphetamine, a controlled substance between 10Jun95 and 30Jun95.
Awarded forfeiture of $400.00 per month for 2 months, restriction and extra duties for 45 days, reduction to Pvt. Not appealed.

960315:  Applicant notified of intended recommendation for discharge under other than honorable conditions by reason of misconduct due to drug abuse.

960315:  Applicant advised of his rights and having elected not to consult with counsel certified under UCMJ Article 27B, elected to waive all rights except the right to obtain copies of the documents used to support the basis for the separation.

960315:  Commanding officer recommended discharge under other than honorable conditions by reason of misconduct due to drug abuse. The factual basis for this recommendation was wrongful use of methamphetamine.

960318:  Counseled for deficiencies in performance and conduct. [Misconduct for illegal use of a controlled substance as evidenced by your admission to CID, for your wrongful use of methamphetamine.] Necessary corrective actions explained, sources of assistance provided, disciplinary and advised of processing for administrative separation.

960329:  SJA review determined the case sufficient in law and fact.

960408:  GCMCA [Commanding General, Marine Corps Base Hawaii] directed the applicant's discharge under other than honorable conditions by reason of misconduct due to drug abuse.


PART III – RATIONALE FOR DECISION AND PERTINENT
REGULATION/LAW

Discussion

The applicant was discharged on 960501 under other than honorable conditions for misconduct due to drug abuse (A and B). The Board presumed regularity in the conduct of governmental affairs (C). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (D and E).

In response to the applicant’s issue, t he NDRB is authorized to consider post-service factors in the recharacterization of a discharge. However, there is no law or regulation which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in the civilian life subsequent to leaving the service. Normally, to permit relief, an error or injustice must have been found to have existed during the period of enlistment in question. Outstanding post-service conduct, to the extent that such matters provide a basis for a more thorough understanding of the applicant’s performance and conduct during the period of service under review, is considered. The applicant provided a marriage certificate, a birth certificate and a drug screen as documentation of his post-service. The Board commends the applicant on starting a family and staying free of drugs, however, t he applicant's efforts need to be more encompassing than those provided. The applicant should have produced evidence of continuing educational pursuits, a verifiable employment record, documentation of community service and church activities, and certification of non-involvement with civil authorities in order for consideration for clemency based on post-service conduct. At this time the applicant has not provided sufficient documentation of good character and conduct. Therefore no relief will be granted. He is encouraged to continue with his pursuits and is reminded that he is eligible for a personal appearance hearing provided the application is received within 15 years from the date of discharge. Relief denied.

Pertinent Regulation/Law (at time of discharge)

A. Paragraph 6210, MISCONDUCT , of the Marine Corps Separation and Retirement Manual, (MCO P1900.16E), effective 18 Aug 95 to Present.

B. The Manual for Courts-Martial authorizes the award of a punitive discharge if adjudged as part of the sentence upon conviction by a special or general court-martial for violation of the UCMJ, Article 112a, for wrongful use of a controlled substance.
