Applicant’s Request

The application for discharge review, received 000706, requested that the characterization of service on the discharge be changed to general/under honorable conditions. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 010125. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/Misconduct – Drug abuse (Use), authority: NAVMILPERSMAN, Article 3630620.

Issues

1. I feel my discharge should be upgraded to general because it was based on one incidence of positive urinalysis which occurred during a process in which the chain of command was broken. During the urinalysis the duty master at arms (who had been previously tested positive for cocaine use) left the test area to go to the quarter deck to call more names for testing. At this time he left another sailor watch the sample. The sailor that was left in charge was a qualified "duty master of arms, however he should not have been left in charge of the samples because he had just given a sample himself. Thank you for your consideration.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 870429 under other than honorable conditions for misconduct due to drug abuse (use) (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

The applicant’s issue states: “I feel my discharge should be upgraded to general because it was based on one incidence of positive urinalysis which occurred during a process in which the chain of command was broken. During the urinalysis the duty master at arms (who had been previously tested positive for cocaine use) left the test area to go to the quarter deck to call more names for testing. At this time he left another sailor watch the sample. The sailor that was left in charge was a qualified "duty master of arms, however he should not have been left in charge of the samples because he had just given a sample himself. Thank you for your consideration.” The NDRB found no evidence in the record that the applicant’s urinalysis was improperly conducted. The applicant provided no evidence or post service documentation to support his request for upgrade. Additionally, the Board found the applicant was dual processed for drug abuse and missing ship’s movement. Relief is not warranted.

The applicant is reminded that he is eligible for a personal appearance hearing provided the application is received within 15 years from the date of discharge. Representation at personal appearance hearing is highly recommended.
