Applicant’s Request
The application for discharge review, received 000705, requested that the characterization of service on the discharge be changed to honorable. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.

Decision

A documentary discharge review was conducted in Washington, D.C. on 010125. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/ Misconduct – Drug abuse (Use), authority: NAVMILPERSMAN, Article 3630620.

PART I - APPLICANT’S ISSUES AND DOCUMENTATION

Issues

 1. My discharge was inequitable and I don't believe I deserved the discharge I received because one incident in my 12 months of service. I don't think my Captains Mast was fair. I didn't get the chance to state all of the facts. A shipmate that was involved in the same incident was not discharged and was punished very lightly. The U.S.S. Independence had just received a new commanding officer. I believe he used my discharge as a way to show the rest of the ship how strict his rules were. The Navy had just charged the disciplinary actions taken against drug users. I don't believe that one incident makes me an addict or deserving of the discharge that I received. I have not used drugs or smoked marijuana since the one incident in the Navy. In fact, I'm an advocate to people not to use drugs because of what happened to me. I have been a meat cutter and have had a steady job since my discharge. I have lived the past 8 years as an upstanding citizen and now have a wife and child.

920430:  NJP for violation of UCMJ, Article 112a: Wrongfully use marijuana, on or about 920320.
         Award: Forfeiture of $392.00 per month for 2 months, restriction for 30 days, reduction to E-1. No indication of appeal in the record.
920328:  Medical evaluation for drug abuse found the applicant to be not drug dependent.
920507:  Applicant notified of intended recommendation for discharge under other than honorable conditions by reason of misconduct due to drug abuse as evidenced by the drug abuse incident during your current enlistment.
920507:          Applicant advised of his rights and having elected not to consult with counsel certified under UCMJ Article 27B, elected to waive all rights except the right to obtain copies of the documents used to support the basis for the separation.
920509:  Commanding officer recommended discharge under other than honorable conditions by reason of misconduct due to drug abuse (use).

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 920618 under other than honorable conditions for misconduct due to drug abuse (use) (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

 The NDRB found no inequity in the applicant’s discharge. An other than honorable discharge accurately characterized his service. While the NDRB may consider post service conduct in an upgrade, the applicant failed to support his request with documentation such as community service, drug test results, police records, and educational pursuits. Relief is not warranted.

 The applicant is reminded that he is eligible for a personal appearance hearing provided the application is received within 15 years from the date of discharge. Representation at personal appearance hearing is highly recommended.
