Applicant’s Request

The application for discharge review, received 991112, requested that the characterization of service on the discharge be changed to general/under honorable conditions. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 000727. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/ Misconduct – Drug abuse (Use), authority: NAVMILPERSMAN, Article 3630620.

1. I was told by naval N.I.S. that if I helped with a sting operation my discharge would be upgraded to General Under Honorable Conditions.
I was discharge because of my drug problem an before I was tested an found positive for cocoaine I ask for help from my chief at that time. I told him of the drug problem within weapons Dept G-1 on USS AMERICA - CV 66 at that point I was ask to talk to N.I.S. but not before I was given a drug test an found positive. I help N.I.S. an my discharge is other than honorable. I ask that the Board upgrade my discharge. Thank you!!

Chronological Listing of Significant Service Events :

880802:  Applicant ordered to active duty for 36 months under the Active Mariner Program.

900502:  NJP for violation of UCMJ, Article 112A (2 specs): (1) Wrongfully use cocaine from 10Feb90 to 20Feb90, (1) Wrongfully use cocaine from 8Mar90 to 18Mar90.

         Award: Forfeiture of $405 per month for 2 months, restriction and extra duty for 45 days, reduction to AA. No indication of appeal in the record.

900507:  Applicant notified of intended recommendation for discharge under other than honorable conditions by reason of misconduct due to drug abuse.

900507:          Applicant advised of his rights and having elected not to consult with counsel certified under UCMJ Article 27B, elected to waive all rights except the right to obtain copies of the documents used to support the basis for the separation.

900511:  Medical evaluation for drug abuse found the applicant to be alcohol and cocaine dependent. Recommend Level III treatment.

900517:  Commanding officer recommended discharge under other than honorable conditions by reason of misconduct due to drug abuse (use).

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 900601 under other than honorable conditions for misconduct due to drug abuse (use) (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

The applicant states in issue 1 that “ I was told by naval N.I.S. that if I helped with a sting operation my discharge would be upgraded to General Under Honorable Conditions.” The Board did not find any evidence in the applicant’s service record nor did the applicant submit any documentation to support this claim. The applicant was found to have used cocaine on 2 separate occasions. Discharge characterizations for drug usage are normally under other than honorable conditions which is what the applicant received. No relief will be granted based on this issue.
