Applicant’s Request
The application for discharge review, received 991019, requested that the characterization of service on the discharge be changed to honorable. The applicant requested a documentary record discharge review. The applicant listed VETERANS SERVICE OFFICE as his representative on the DD Form 293.

Decision

A documentary discharge review was conducted in Washington, D.C. on 000720. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/Misconduct - Pattern of misconduct, authority: NAVMILPERSMAN, Article 3630600.

PART I - APPLICANT’S ISSUES AND DOCUMENTATION

Issues (verbatim)

 1. Discharge with OTH was not equitable when compared to other servicemen with the same offenses I had. My military offenses consisted with two periods of absence - one with less than 2 hours while the other one was not an absence. I only missed muster because I was on duty standing on watch. I can't be at two places at one time. I was very young when I was drunk and only once.

2. My military Bearing and Personal Behavior marks from enlistment to discharge date were 3.2's and 3.6's and were above the minimum requirement of 3.0 for Honorable discharge.

3. Contrary to the claim by the parent command, I was not provided a counseling by a JAG Counsel who is qualified under UCMJ Article 31 (b) before I was given administrative discharge.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 900831 under other than honorable conditions for misconduct due to a pattern of misconduct (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

In the applicant’s issue 1, the Board found that the discharge was equitable based on the 3 NJPs for misconduct. Under these circumstances, a discharge characterization is normally under other than honorable conditions. The applicant’s service is accurately characterized and therefore no relief will be granted based on this issue.

Although the applicant’s evaluation marks were above a 3.0, his misconduct outweighs any good he may have done while in the service.

In response to the applicant’s issue 3, the applicant was given his proper rights and acknowledged them on 900802. The applicant elected NOT to consult with counsel, in addition to waiving all his rights except to obtain copies of documents to be forwarded to NMPC. His signature and initials were cited by the Board. No relief will therefore be granted.
