Applicant’s Request

The application for discharge review, received 000626, requested that the characterization of service on the discharge be changed to general/under honorable conditions. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.

Decision

A documentary discharge review was conducted in Washington, D.C. on 010201. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/Misconduct-Drug abuse (with administrative discharge board), authority: MARCORSEPMAN Par. 6210.5.

870930:  Reenlisted at 4THBN 12THMAR 3DMARDIV for 4 years.

880111:  Counseled for deficiencies in performance and conduct. [Unsatisfactory performance of duty as Orders Clerk, specifically, SNM counseled due to inattention of detail and lack of initiative by failing to initiate action to correct discrepancies noted on PCS travel claims for Marines of this battalion and failing to track orders and travel claims.] Necessary corrective actions explained, sources of assistance provided, disciplinary and discharge warning issued.

890324:  NJP for violation of UCMJ, Article 112a: Wrongful use of marijuana on or about 890109.
Awarded forfeiture of $300.00 per month for 2 months, restriction for 20 days, extra duties for 25 days, reduction to E-3. Not appealed.

890328:  Counseled for deficiencies in performance and conduct. [Your positive urinalysis for marijuana which resulted in NJP] Necessary corrective actions explained, sources of assistance provided, disciplinary and discharge warning issued.

890329:  Medical evaluation for drug abuse found the applicant to be not drug dependent

890518:  NAVDRUGLAB [SAN DIEGO, CA], reported applicant’s urine sample, received 890509, tested positive for [THC].

890526:  Applicant notified of intended recommendation for discharge under other than honorable conditions by reason of misconduct due to drug abuse.

890526:  Commanding Officer, H&H MCAS El Toro CA recommended discharge under other than honorable conditions by reason of misconduct due to drug abuse. The factual basis for this recommendation was your NJP of 890316 for positive urinalysis and your recent positive urinalysis while on the Unit Surveillance Program.

890621:  Applicant advised of his rights and having consulted with counsel certified under UCMJ Article 27B, elected to appear before an Administrative Discharge Board.

890801:  An Administrative Discharge Board, based upon a preponderance of the evidence and by unanimous vote, found that the applicant had committed misconduct due to drug abuse, that the misconduct warranted separation, and recommended discharge under other than honorable conditions.

890804:  SJA review determined the case sufficient in law and fact.

890807:  GCMCA [Commander, Marine Corps Air Bases Western Area] directed the applicant's discharge under other than honorable conditions by reason of misconduct due to drug abuse.


PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 890914 under other than honorable conditions for misconduct due to drug abuse (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

The applicant states in issue 1, that he cannot better himself with this discharge. The Board determined this issue is without merit. The NDRB is under no obligation to upgrade an applicant’s discharge to allow him to better himself. The applicant knowingly used THC, a drug he knew to be illegal, at least 2 times in his second enlistment. He was correctly discharged. Relief denied.

Issue 2 is non-decisional. The applicant abused THC, was caught and administratively discharged in accordance with regulations. Relief denied.
