Applicant’s Request

The application for discharge review, received 000314, requested that the characterization of service on the discharge be changed to general/under honorable conditions. The applicant requested a personal appearance hearing discharge review before the board in the Washington National Capital Region. The applicant listed the Veterans of Foreign Wars as his representative on the DD Form 293.


Decision


A personal appearance hearing discharge review was conducted in Washington, D.C. on 000921. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned an inequity, but no impropriety in the characterization of the applicant’s service. The Board’s vote was 4 to 1 that the character of the discharge shall change to: UNDER HONORABLE CONDITIONS (GENERAL)/Misconduct – Minor disciplinary infractions (with administrative discharge board), authority: MARCORSEPMAN Par. 6210.2.

1. I would like my discharge reviewed based upon my life and achievements since September 27, 1991. My intention is for an upgrade in my R.E. code and type of discharge, so that I may fulfill my duty to the Corps and country by earning an honorable discharge in the Marine Corps Reserves. Specification: Fail to obey a lawful general order, to wit: consumed alcoholic beverages in barracks on 2100, 8Apr90.

The factual basis for this recommendation was your failure to participate in your own recovery and your discreditable involvement with authorities during this enlistment as evidenced by three nonjudicial punishments and other adverse entries contained on page 11 of your service record.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 910927 under other than honorable conditions for misconduct due to minor disciplinary infractions (A and B). The Board presumed regularity in the conduct of governmental affairs (C). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper, but inequitable (D and E) based on post-service accomplishments.

The applicant states in issue 1 that he would like his “discharge reviewed based upon” his “life and achievements since September 27, 1991. My intention is for an upgrade in my R.E. code and type of discharge, so that I may fulfill my duty to the Corps and country by earning an honorable discharge in the Marine Corps Reserves. Please view my letter addressing the board that details my resume' with its attached A through HH, and newspaper articles 1, 2, and 3.” In response to the applicant’s issue 1, the Board found that the applicant’s post-service accomplishments were significant and warranted relief to under honorable conditions (general). The applicant provided documentation of various accomplishments to include his Bachelor’s of Arts degree, his induction into the Phi Theta Kappa Society, his enrollment in Law School and various letters of recommendation and commendation. Relief is granted.

The applicant is advised that the Board has no authority to change re-enlistment codes or make recommendations to permit re-entry into the Naval Service or any other of the Armed Forces. Neither a less than fully honorable discharge nor an unfavorable “RE” code is, in itself, a bar to re-enlistment. A request for waiver is normally done only during the processing of a formal application for enlistment.

Pertinent Regulation/Law (at time of discharge)

A. Paragraph 6210, Misconduct, of the Marine Corps Separation and Retirement Manual, ( MCO P1900.16D), effective 27 Jun 89 until 17 Aug 95.

B. The Manual for Courts-Martial authorizes the award of a punitive discharge if adjudged as part of the sentence upon conviction by a special or general court-martial for violations of the UCMJ.
