Applicant’s Request

The application for discharge review, received 991228, requested that the characterization of service on the discharge be changed to Honorable. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 000831. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: GENERAL (UNDER HONORABLE CONDITIONS)/MISCONDUCT, authority: MARCORSEPMAN Par. 6210.3.

9707XX:  Applicant arrested for assaulting his wife. Applicant acknowledged that he had hit and kicked his wife, but failed to accept responsibility for his actions.
970812:  Counseled for deficiencies in performance and conduct. [Unbecoming a Marine for spouse abuse.] Necessary corrective actions explained, sources of assistance provided, disciplinary and discharge warning issued

Violation of UCMJ, Article 111:
Specification: Drunk driving on 1Nov98.
Awarded forfeiture of $519.00 per month for 2 months, restriction and extra duties for 45 days, reduction to PFC. No indication of appeal.

990204:          Applicant advised of his rights and having consulted with counsel certified under UCMJ, Article 27B, elected to appear before an Administrative Discharge Board.

990204:  Commanding officer recommended discharge under Other Than Honorable conditions by reason of misconduct due to Minor disciplinary infractions and/or a Pattern of misconduct. The factual basis for this recommendation was seven page 11 entries and three nonjudicial punishments.

990222:  An Administrative Discharge Board, based upon a preponderance of the evidence and by unanimous vote, found that the applicant had committed misconduct due to a Pattern of misconduct and misconduct due to Minor disciplinary infractions, that the misconduct warranted separation, and recommended discharge General (under Honorable conditions).

980308:  SJA review determined the case sufficient in law and fact.

980310:  GCMCA [Commanding General, I Marine Expeditionary Force] directed the applicant's discharge General (under Honorable conditions) by reason of misconduct due to a Pattern of misconduct.


PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 990318 General (under Honorable conditions) for misconduct due to a Pattern of misconduct (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

In the applicant’s issue 1, the Board determined this issue is without merit. The applicant claims the documents that he included with his application (excerpts from the Marine Corps Separations Manual), concerning reasons for discharge, are evidence enough to support upgrading his discharge. The Board determined the separations manual fully supports the decision to separate the applicant for misconduct due to a pattern of misconduct. The applicant did not provide sufficient documentation to consider post-service conduct as a reason to upgrade his discharge. The Board determined the discharge was proper and equitable. Relief denied.
