Applicant’s Request

The application for discharge review, received 990820, requested that the characterization of service on the discharge be changed to honorable. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 000427. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/Misconduct - Pattern of Misconduct, authority: NAVMILPERSMAN, Article 3630600.



PART I - APPLICANT’S ISSUES AND DOCUMENTATION

Issues

1. My discharge was improper because I was wrongfully accused of distributing 1/8 ounce of cocaine and to conspire with a friend to distribute. I did not do any of the above. I was there at the wrong place and wrong time.
I had a military lawyer that had no prior experience in my situation. And I feel my lawyer did not do a good job or did her job at all.
I served in the military for 3 years and extended for another year. I was entitled to wear the National Defence Medal, Armed Forces Expeditionary Medal and Sea Service Deployment Ribbon (2
nd award).
I've never experimented with cocaine nor sold it in my life. My urinalysis and the search of my barracks was negative. Most of all my witnesses (the drug dealers) said I had nothing to do with what happened that evening.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 911007 under other than honorable conditions for misconduct due to a pattern of misconduct (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

Responding to the applicant’s issue, the Board found nothing in the records, nor did the applicant provide anything to indicate or to show that there exists an error of fact, law, procedure, or discretion, associated with his discharge at the time of issuance, and that his rights were prejudiced thereby. Furthermore, r
elevant and material facts stated in a court-martial specification are presumed by the NDRB to be established facts. Relief denied.
