Applicant’s Request

The application for discharge review, received 981016, requested that the characterization of service on the discharge be changed to honorable. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 990927. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. Issues

1. In late Nov. 1984, I lost my mother and all of my personal belongings in a fire at her apartment, when I was on leave. I reported to duty in Levis blue jeans and a T-shirt. I was a hard worker in the Navy, but I suffered from the tragic loss of my mother. I was wrong for my pattern of misconduct and I apologize. Please upgrade my discharge to Honorable. I didn't know how to cope with the loss of my mother at the time of my active duty. Sincerly

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 870622 under other than honorable conditions for misconduct due to a pattern of misconduct (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

The applicant cites the tragic loss of his mother in 1984 as reason for his misconduct.

The following is provided for the applicant’s edification. The NDRB is authorized to permit relief if an error or injustice is found in the record during the period of the enlistment. There is no law or regulation that provides that an unfavorable discharge may be upgraded based solely on the passage of time.

The applicant was recommended for Level III substance abuse treatment on 8 Jan 87. He was subsequently issued a retention warning for failure to obey lawful orders on 18 Feb 87. This warning advised that any further violations of the Uniform Code of Military Justice could result in applicant’s administrative separation from the service. While awaiting Level III treatment the applicant violated Article 86 (Unauthorized absence), Article 112A (Wrongfully use of a controlled substance [cocaine]), and Article 134 (Drunk and disorderly conduct). These serious offenses of the Uniform Code of Military Justice could have resulted in a Bad Conduct or a Dishonorable discharge. Accordingly, relief will not be granted.
