Applicant’s Request

The application for discharge review, received 990802, requested that the characterization of service on the discharge be changed to entry level separation or uncharacterized. The applicant requested a documentary record discharge review. The applicant did not designate a representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 000417. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/MISCONDUCT, authority: NAVMILPERSMAN, Article 3630620.

950603:  NJP for violation of UCMJ, Article 86: unauthorized absence.
Award: Forfeiture of $300 per month for 2 months (one month suspended), restriction and extra duty for 30 days. No indication of appeal in the record.

950620:  NAVDRUGLAB Jacksonville, FL: Urinalysis testing on 9 Jun 95, received sample by 13 June 95 reported applicant tested positive for marijuana.

950724:  NJP for violation of UCMJ, Article 112a: did on or about 09Jun95 wrongfully use marijuana.

Award: Restriction and extra duty for 45 days, reduction to E-1. No indication of appeal in the record.

950731:  Applicant notified of intended recommendation for discharge under other than honorable conditions by reason of misconduct due to drug abuse as evidenced by your non-judicial punishment of 24 July 1995 for violation of Article 112a, UCMJ.

950731:  Applicant advised of his rights and having elected not to consult with counsel certified under UCMJ Article 27B, elected to waive all rights except the right to obtain copies of the documents used to support the basis for the separation.

950811:  CAAC evaluation for drug abuse found the applicant to be a drug abuser, not drug dependent.

950814:  Commanding officer recommended discharge under other than honorable conditions by reason of misconduct due to drug abuse (use).
Commanding officer’s comments (verbatim): "In the short time that he has been in the Navy, SR (Applicant) was afforded every opportunity to succeed in the Navy through effective leadership, counseling and trust. Based on his UA and drug use, it is apparent that he has failed to accept responsibility as a mature sailor in his personal and professional role within the military environment. Accordingly, SR (Applicant) is no longer suited for further useful military service. He is strongly recommended for immediate discharge under other than honorable conditions as soon as possible.

950815:  DAAR/SAR if available: Unit sweep, positive for marijuana, date of incident 08JUN95, screened by CAAC, recommend process for separation and not via VA hospital.

950912:  BUPERS directed the applicant's discharge under other than honorable conditions by reason of misconduct due to drug abuse (use).

Discussion

The applicant was discharged on 950920 under other than honorable conditions for misconduct due to drug abuse (use) (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

The applicant introduced no decisional issues for consideration by the Board.
