Applicant’s Request
The application for discharge review, received 990406 requested that the characterization of service on the discharge be changed to honorable. The applicant requested a documentary record discharge review. The applicant did not list a representative on the DD Form 293.

Decision

A documentary discharge review was conducted in Washington, D.C. on 000110. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/Misconduct – Pattern of misconduct, authority: NAVMILPERSMAN, Article 3630600.

870422:  NJP for violation of UCMJ, Article 134: Incapacitation for the proper performance of duty, violation of UCMJ Article 86: Failure to go to place of appointed duty, violation of UCMJ Article 92 (2 Specs): (1) Wrongful possession of another service member’s liberty card, (2) Wrongful possession of an altered liberty card.
         Award: Restriction and extra duty for 45 days. No indication of appeal in the record.

871027:  Retention Warning from USS GARY (FFG 51): Advised of deficiency (Conduct, Unauthorized absence, incapacitation for duty, and failure to obey lawful orders), notified of corrective actions and assistance available, advised of consequences of further deficiencies, and issued discharge warning.

880703:  NJP for violation of UCMJ, Article 86: Absent without leave from 0715-1000 88062. Violation of Article 92: Failure to obey a lawful order.
         Award: Forfeiture of $335 per month for 2 month(s), reduction to E-1. Reduction in rate suspended for six months. No indication of appeal in the record.
881213:  Vacation of suspended reduction in rate to E-1 effective this date due to further misconduct.

890309:          NJP for violation of UCMJ, Article 86: Absent from place of appointed duty. 5 Specs of missing restriction muster.
Award: Forfeiture of on half monts pay for two months. Restriction to the confines of the ship for 60 days. No indication of appeal in the record.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 890518 under other than honorable conditions for misconduct due to a pattern of misconduct (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

Regarding issue 1, the Board found the applicant’s completion of an alcohol rehabilitation program while on active duty irrelevant and non decisional. Relief not warranted.

 The applicant is reminded that he is eligible for a personal appearance hearing provided the application is received within 15 years from the date of discharge. Representation at personal appearance hearing is highly recommended.
