Applicant’s Request

The application for discharge review, received 990302, requested that the characterization of service on the discharge be changed to honorable. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 000104. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/MISCONDUCT, authority: NAVMILPERSMAN, Article 1910 - 142 (formerly 3630605).

The NDRB did note an administrative error on the original DD Form 214. Block 25, Separation Authority should read: "MILPERSMAN 1910-142" vice "MILPERSMAN 1910-600, Block 26, Separation Code should read: “HKQ” vice “HKA”. The original DD Form 214 should be corrected or reissued as appropriate.






PART I - APPLICANT’S ISSUES AND DOCUMENTATION

Issues

1. I (applicant) respectfully request that my discharge under other than honorable conditions be upgraded to an honorable discharge. I have been out of the service from seven months through which I have gone through counseling to control my anger and my actions that took place aboard the U.S.S. THEODORE ROOSEVELT. I have no more thought of suicide or harming my self in any way. I have learned the true values of life and would like a second chance at it. My counselor, Mr. J_ H_ of Wesley Hilltop House in Elizabethtown, KY 42701 gave me plenty of insight and knowledge to help me over come my problems. If my request is approved I plan to join the US. Air Force. Before I joined the Navy I rushed into a decision. Now that I have overcooked my options and decided that the military is for me, but not the Navy. I have no hard feelings toward the Navy at all. I enjoyed it an it was an experience which I will never forget, but different people are made for different service. The Lord did what he did for some reason. Maybe he did it to make me wake up. I would give the upmost and sincere respect if the board would consider upgrading my discharge.

         Charge I: violation of the UCMJ, Article 86.

         Finding: to Charge I and the specification thereunder, guilty.
         Sentence: Forfeiture of $300.00, confinement for 30 days, reduced to OSSR.
         CA action 971215: Sentence approved and ordered executed.

980720:  Applicant released from confinement and returned to full duty.

980626:  Applicant notified of intended recommendation for discharge under other than honorable conditions by reason of misconduct due to the commission of a serious offense.

980626:          Applicant advised of his rights and having elected not to consult with counsel certified under UCMJ Article 27B, elected to waive all rights except the right to obtain copies of the documents used to support the basis for the separation.

980720:  Commanding officer recommended discharge under other than honorable conditions by reason of misconduct due to the commission of a serious offense.

980721:  Commander, Carrier Group EIGHT directed the applicant's discharge under other than honorable conditions by reason of misconduct due to the commission of a serious offense.


PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 980720 under other than honorable conditions for misconduct due to commission of a serious offense (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

The applicant’s introduced no decisional issues for consideration by the Board.
The following is provided for the applicant’s edification. The NDRB is authorized to consider post-service factors in the recharacterization of a discharge. The applicant must be aware that there is no law or regulation which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in the civilian life subsequent to leaving the service. Normally, to permit relief, an error or injustice must have been found to have existed during the period of enlistment in question. Outstanding post-service conduct, to the extent that such matters provide a basis for a more thorough understanding of the applicant’s performance and conduct during the period of service under review, may be considered by the NDRB. The applicant is reminded that he is eligible for a personal appearance hearing provided the application is received within 15 years from the date of discharge. Representation at personal appearance hearing is highly recommended.
