Applicant’s Request

The application for discharge review, received 990224, requested that the characterization of service on the discharge be changed to honorable. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 000522. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: GENERAL (UNDER HONORABLE CONDITIONS)/PATTERN OF MISCONDUCT, authority: NAVMILPERSMAN, Article 1910-140 (formerly 3630600).

1. I enlisted in the Navy with the intent of making it my career.
I volunteered for the sub service with the understanding that I could transfer to the surface fleet if I desired. I graduated #5 in my Div at Great Lakes & completed sub school at New London. I was assigned to the HENRY JACKSON SSBN 730, I was put on the mess deck for 6 mo. straight, longer than any other crew member. When I complained I was told I needed more training & was sent to "corrective custody" for 30 days at the end of this period. The counselor wrote a letter stating I was a good troop. Upon my return to the HENRY JACKSON I was told by the C.O.B. that I was history & the process was started to discharge me. I sincerely want to make the Navy my career and don't thing my troubles a board the JACKSON should keep me from reenlisting.

PART III – RATIONALE FOR DECISION AND PERTINENT
REGULATION/LAW

Discussion

The applicant was discharged on 980710 general (under honorable conditions) for misconduct due to a pattern of misconduct (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

In response to the applicant’s issue, the Board has to presume regularity in the conduct of government affairs. Neither the applicant or his former command submitted any required information concerning the applicant’s discharge. The applicant also did not provide any post-service documentation for the Board to consider. Relief will not be granted at this time.

The following is provided for the applicant’s edification. The NDRB is authorized to consider post-service factors in the recharacterization of a discharge. The applicant must be aware that there is no law or regulation which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in the civilian life subsequent to leaving the service. Normally, to permit relief, an error or injustice must have been found to have existed during the period of enlistment in question. Outstanding post-service conduct, to the extent that such matters provide a basis for a more thorough understanding of the applicant’s performance and conduct during the period of service under review, may be considered by the NDRB. The applicant
is reminded that he is eligible for a personal appearance hearing provided the application is received within 15 years from the date of discharge. Representation at personal appearance hearing is highly recommended.
