Applicant’s Request

The application for discharge review was received on 20030612. The Applicant requests the characterization of service received at the time of discharge be changed to honorable. The Applicant requests a documentary record review. The Applicant did not list any representative on the DD Form 293.


Decision

A documentary review was conducted in Washington, D.C. on 20040608. After a thorough review of the available records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge shall not change. 1. “To the Board reviewing my Records, First I would like to apologize for any inconvienance or added stress in this matter. Solely I would like to request an upgrade from general to Honorable. While I was in the service I served a 9-month deployement on the USS Enterprise all throughout that deployment I had no real issues or problems. I feel as though that period of my service was the most vulnerable to issues concerning discharge but all my problems came when we came b ack to the shore. I don’t want to make excuses I know I messed up but I still served my country. The reason I need this upgrade is so my educational benifits or MGIB can fully count or be used. I believe that my Discharge from the Navy was punishment enough not to mention my time spent in CCU for a Disagreement or Misunderstanding with my irst class, but to take my education is wrong and I sincerly request a review of my record and reconsideration for my Discharge.”

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 20020328 with a general (under honorable conditions) for misconduct due to a pattern of misconduct (A). In the absence of a complete discharge package, the Board presumed regularity in the conduct of governmental affairs (B) and, after a thorough review of available records, supporting documents, facts, and circumstances unique to this case, found that the discharge was proper and equitable (C and D).

Issue 1.
The Veterans Administration determines eligibility for post-service benefits not the Navy Discharge Review Board. There is no requirement or law that grants recharacterization solely on the issue of obtaining Veterans' benefits and this issue does not serve to provide a foundation upon which the Board can grant relief. Additionally, the Board has no authority to upgrade a discharge for the sole purpose of enhancing employment or educational opportunities. Regulations limit the Board’s review to a determination on the propriety and equity of the discharge.

The NDRB, under its responsibility to examine the propriety and equity of an Applicant’s discharge, is authorized to change the character of service and/or the reason for discharge if such change is warranted. There is no evidence of impropriety or inequity in the Applicant’s discharge. Therefore, relief is denied.

The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of discharge. The Applicant can provide documentation to support any claims of post-service accomplishments or any other evidence related to his discharge at that time. Representation at a personal appearance hearing is recommended but not required.
