Applicant’s Request
The application for discharge review, received 990203, requested that the characterization of service on the discharge be changed to general/under honorable conditions. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.

Decision

A documentary discharge review was conducted in Washington, D.C. on 991206. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/MISCONDUCT, authority: NAVMILPERSMAN, Article 3630620.

1.       I feel that my discharge should be upgraded due to the fact that during my 3 years of service, I had never been in any trouble. I was an exceptional sailor with no bad marks. At one point in my naval career I had admitted my problem with alcohol to the medical unit on my ship. The doctors with whom I spoke told me that I didn't have a problem. I just needed to learn to drink socially.
2.       I have the disease of chemical dependency. I progressed from alcohol to marijuana. I fought with my addiction throughout the navy career that I chose, and it just got worse. After my discharge from the Navy my problem still progressed. But today I am a member of Alcoholic Anonymous and I have seeked counseling. I am sober today, and dealing with my addiction.

         Award: Forfeiture of $490.00 per month for 2 months, restriction and extra duty for 45 days, reduction to E-2. No indication of appeal in the record.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 970103 under other than honorable conditions for misconduct due to drug abuse (use) (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

In response to the applicant’s issues 1 and 2, the Board does not accept alcohol abuse as a factor sufficient to exculpate the applicant from the consequences of his misconduct. While the Board recognizes that alcoholism and alcohol abuse are not, in themselves, offenses which constitute grounds for punishment, it reminds applicants who commit offenses while drinking that they are still responsible for their actions. They must accept the consequences of their misconduct or misbehavior, whether committed before or after they received rehabilitation treatment.
