Applicant’s Request

The application for discharge review, received 990126, requested that the characterization of service on the discharge be changed to Honorable. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 991130. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/MISCONDUCT - Drug abuse (Use), authority: NAVMILPERSMAN, Article 3630620.

I would like to be given consideration for re-enlistment in the Navy to better serve my country in a fashion commensurate with the highest expectations set forth by the demands of the Navy.          Award: Forfeiture of $437.40 per month for 2 months, restriction and extra duty for 45 days. No indication of appeal in the record.

960318:  Applicant notified of intended recommendation for discharge under Other Than Honorable conditions by reason of Misconduct due to Drug abuse as evidenced by all punishments under the UCMJ in your current enlistment.

960318:          Applicant advised of his rights and having elected not to consult with counsel certified under UCMJ, Article 27B, elected to waive all rights except the right to obtain copies of the documents used to support the basis for the separation.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 960506 under Other Than Honorable conditions for Misconduct due to Drug abuse (Use) (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

In the applicant’s issue 1, the Board determined this issue is without merit. The NDRB is under no obligation to upgrade an applicant’s discharge to allow him/her the opportunity to re-enlist into any branch of the armed services. The applicant states he has learned from his mistake and the NDRB has no doubt that he has but the Board must look at the equity and propriety of the discharge to determine if an error occurred which would warrant recharacterization of the discharge. No such error occurred. Additionally, the NDRB is authorized to consider post-service factors in the recharacterization of a discharge, with verifiable documentation. Those factors include but are not limited to the following: Evidence of continuing education, a verifiable employment history, documentation of community service, certification of non-involvement with civil authorities and proof of not using drugs. The applicant has not submitted any evidence of post-service accomplishments that would warrant upgrading his discharge. Therefore, relief is denied.

Although relief has been denied, the applicant is encouraged to schedule a personal appearance hearing, after establishing a reputation that would warrant an upgrade to his discharge. Legal representation is strongly recommended. Again, document any achievements, in preparation for the personal appearance hearing.

The applicant will remain eligible for a personal appearance hearing, provided an application is received within 15 years from the date of discharge.
