Applicant’s Request

The application for discharge review, received 990210, requested that the characterization of service on the discharge be changed to general/under honorable conditions. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 991206. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/Misconduct – Pattern of misconduct (administrative discharge board required but waived), authority: MARCORSEPMAN Par. 6210.3.

The NDRB did note an administrative error on the original DD Form 214. Block 28, Narrative Reason for Separation should read: “Misconduct-Pattern of misconduct (administrative discharge required but waived” vice “Misconduct-Pattern of misconduct (with administrative discharge board)”. The original DD Form 214 should be corrected or reissued as appropriate.

Issues

1. I was stationed in Okinawa Japan. On a deployment to mainland Japan out in the field we have several posts to watch. I was on my post from 7:30 to 15:30. Fell asleep at 15:00. They found me and punished me I spoke with other Marines about the situation. Almost all of them fell asleep for a little while. They just caught me. Please upgrade my discharge I am now disabled. Cause of a very bad auto accident.

930819:          Applicant advised of his rights and having consulted with counsel certified under UCMJ Article 27B, elected to waive all rights except the right to obtain copies of the documents used to support the basis for the separation.

930819:  Commanding officer recommended discharge under other than honorable conditions by reason of misconduct due to a pattern of misconduct. The factual basis for this recommendation was three (3) nonjudicial punishments and counseled concerning his deficiencies.

930916:  GCMCA [Commanding General, 3d Marine Division] directed the applicant's discharge under other than honorable conditions by reason of misconduct due to a pattern of misconduct.


PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 931008 under other than honorable conditions for misconduct due to a pattern of misconduct (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

The applicant is under the false impression that he was discharged for one incident, falling asleep on watch. This was not the case. The applicant was discharged for a pattern of misconduct that covered a period of five months. The 3 NJP’s he received were the basis for his discharge. Relief denied.
