This is in reference to your application for correction of your
naval record pursuant to the provisions of Title 10, United
States Code, Section 1552.

A three-member panel of the Board for Correction of Naval
Records, sitting in executive session, considered your
application on 16 March 2010. The names and votes of the
members of the panel will be furnished upon request. Your
allegations of error and injustice were reviewed in accordance
with administrative regulations and procedures applicable to the
proceedings of this’ Board. Documentary material considered by
the Board consisted of your application, together with all
material submitted in support thereof, your naval record and
applicable statutes, regulations, and policies. In addition, the
Board considered the Transmittal of and/or Entitlement to Awards
document (NAVPERS 1650/96) dated 2 October 2009 furnished by the
Navy Personnel Command, Retired Records Section (PERS-312);, a
copy of which is attached.

Your record reflects that during the period from 20 July 1967 to
30 September 1970 you honorably served for a total of 3 years, 2
months, and 11 days. As such you did not meet the criteria
required for award of a Good Conduct Medal. In this regard,
during the period in which you served, a Sailor had to honorably
serve for four continuous years on active duty to be awarded a
Good Conduct Medal. Finally, the Board further considered your
request to have your Certificate of Release or Discharge from
Active Duty (DD Form 214) amended to reflect the award of the
Navy “E” Ribbon based on the administrative remarks entry dated 1
September 1969. However, the Board noted that you should contact
the Department of the Navy, Navy Personnel Command (BUPERS),
Sailor Assistance Center, Code Pers-312F, 5720 Integrity Drive,
Millington, TN 38055-3120 to request administrative corrections,
such as this, to be made on your DD Form 214.

In regards to the foregoing, the Board substantially concurred
with the comments contained in the NAVPERS 1650/96 document.

Accordingly, your application has been denied.

It is regretted that the circumstances of your case are such that
favorable action cannot be taken. You are entitled to have the
Board reconsider its decision upon submission of new and material
evidence or other matter not previously considered by the Board.

In this regard, it is important to keep in mind that a
présumption of regularity attaches to all official records.
Consequently, when applying for a correction of an official naval
record, the burden is on the applicant to demonstrate the
existence of probable material error or injustice.
