You requested, in effect, that the fitness reports for 15 April
to 31 December 2005 and 1 January to 9 June 2006 be modified, in
accordance with the reporting senior’s (RS’s) undated letter, by

changing the marks in sections F.] (“Leading Subordinates”), F.2
(“Developing Subordinates”) and F.4 (“Ensuring Well-being of
Subordinates”) from “H” (not observed) to “p” (fourth best of

seven possible marks) in the case of the report for 15 April to
31 December 2005, and “EF” (third best) in the case of the report
for 1 January to 9 June 2006; and further modifying the report
for 15 April to 31 December 2005 by changing the entry in
section A, item 1.f (“DOR [date of rank]”), from “20040401” to
“20000401.” Tt is noted the report of record already reflects

the requested entry “20000401.”

Records, sitting in executive session, considered your
application on 31 January 2008. Your allegations of error and
Review Board (PERB), dated 18 October 2007, a copy of which is
attached.

After careful and conscientious consideration of the entire
record, the Board found that the evidence submitted was
insufficient to establish the existence of probable material
error or injustice. In this connection, the Board substantially
concurred with the comments contained in the report of the PERB.
Accordingly, your application has been denied. The names and
votes of the members of the panel will be furnished upon
request.

Although the Board voted not to modify the fitness reports in

question, you may submit the RS’s letter to future selection
boards.

It is regretted that the circumstances of your case are such
that favorable action cannot be taken. You are entitled to have

the Board. In this regard, it is important to keep in mind that
a presumption of regularity attaches to all official records.
Consequently, when applying for a correction of an official
naval record, the burden is on the applicant to demonstrate the
existence of probable material error or injustice.
