This is in reference to your application for correction of your naval record pursuant to the provisions of 10 Usc 1552.

A three-member panel of the Board for correction of Naval Records, sitting in executive session, considered your application on 8 May 2007. Your allegations of error and injustice were reviewed in accordance with the administrative regulations and procedures applicable to the proceedings of this Board. Documentary material considered by the Board consisted of your application, together with all material submitted in support thereof, your naval record and applicable statutes, regulations and policies. In addition, the Board considered the advisory opinion furnished by }-JQMC Memo 1040 MMEA dtd 2 May 07, a copy of which is attached.

After careful and conscientious consideration of the entire record, the Board found that the evidence submitted was insufficient to establish the existence of probable material error or injustice. In this connection, a majority of the Board substantially concurred with the comments contained in the advisory opinion. Accordingly, the majority recommended that your application be denied and that no changes be made to your record. On 14 June 2007, the Board’s findings and recommendations were reviewed by the Assistant Secretary of the Navy (M&RA) who approved the majority recommendation (to deny relief). Accordingly, your application has been denied. The names and votes of the members of the panel will be furnished upon request .

It is regretted that the circumstances of your case are such that favorable action cannot be taken. You are entitled to have the Board reconsider its decision upon submission of new and
material evidence or other matter not previously considered by the Board.







In this regard, it is important to keep in mind that a presumption of regularity attaches to all official records. consequently, when applying for a correction of an official naval record, the burden is on the applicant to demonstrate the existence of probable material error or injustice.

MEMORANDUM FOR EXECUTIVE DIRECTOR, BOARD FOR CORRECTION OF NAVAL RECORDS

1. We have carefully reviewed the subject request and the following comments are provided.

2 On 29 January 2007, ~ ~n submitted a request for a 48 month reenlistment via his chain of command. On 6 February 2007 this headquarters approved his request and subsequently he reenlisted on 2 March 2007.
         3.       Regrettably, Gunner      ~~reenlistment authority
erroneously reflected that he may é e]1g±ble for a Selective Reenlistment Bonus (SRB) multiple of 4 in Zone C. Per the reference, 4he actually rated a SRB multiple of 3 in Zone C.

4. Fortunately, Gunnery rft*tjI1I~JF disbursing office noticed the error in the SRB multiple and credited his account with the proper payment, avoiding the inconvenience that a mis-payment and subsequent pay checkage may have caused him.

5 This headquarters recommends that Gunnery slt....~ 1l~~-~eceive no additional SRB monies This headquarters also re&~nends that Gunnery~1F~ 1L DD Form 4 be corrected to reflect “REENLIS~~NT INCENTIVES: ZONE C SRB MULTIPLE (3)” vice “REENLISTMENT INCENTIVES: ZONE C SRB MULTIPLE (4)”

~        It should be noted that Gunnery ~ ~flJ~did receive an additional monetary incentive to his reenlistment. He was paid $10,000.00 under the Assignment Incentive Pay program, which was approved after he submitted his original request for reenlistment.
