This is in reference to your applicati o n for correction of your naval record pursuant to the provision of title 10 of the United States Code, section 1552.

A three-member panel of the Board for c orrection of Naval Records, sitting in executive session, considered your application on 28 November 2006. Your allegations of error and injustice were reviewed in accordance with administrative regulations and procedures applicable o the proceedings of this Board. Documentary material considere d by the Board consisted of your application, together with all ma t erial submitted in support thereof, your naval record and applica tion statutes, regulations and policies. In addition, the Board c onsidered an advisory opinion furnished by Headquarters Man e Corps, a copy of which is enclosed.

After careful and conscientious consider ation of the entire record, the Board found that the evide n ce submitted was insufficient to establish the existence of probable material error or injustice. In this connection the Board substantially concurred with the comments contained n the advisory opinion.

Accordingly, your application has been denied. The names and votes of the members of the panel will be furnished upon request.

It is regretted that the circumstances of your .case are such that favorable action cannot be taken. You are entitled to have the Board reconsider its decision upon sub m ission of new and material evidence or other matter not previousl y considered by the Board. In this regard, it is important to kee p in mind that a presumption of regularity attaches to 11 official records. Consequently, when applying for a corr e ction of an official naval record, the burden is on the applicant to demonstrate the existence of probable material error o injustice.

1.       The reference requests an advisory opinion concerning the basis of       discharge.

3.       A review of his Official Military P ersonnel File shows he was assigned for active duty training or a period of six months starting 25 July 1960 at which time he began recruit training at MCRD, San Diego, CA then Individual Co at Training (ICT) at Camp Pendleton, CA. He was released f om active duty training on 24 January 1961 and joined his rese ye unit the next day and served with honor until his discharge n 03 June 1966.

4.       Based on this information it is ap arent that 4IU~. was called to active duty for initial ecruit and individual combat training and not specifically i support of the Cuban Missile Crisis. As a result, there wa no error in marking his DD Form 214 “AD TNG” and this marking n no way detracts from the quality of his service.
