This is in reference to your application for correction of your naval record pursuant to the provisions of 10 USC 1552.

A three-member panel of the Board for Correction of Naval Records, sitting in ecutive session, considered your application on 9 May 2006. Your allegations of error and injustice were reviewed in accordance ith administrative regulations and procedures applicable to the proc edings of this Board. Documentary material considered by the Board co sisted of your application, together with all material submitted i support thereof, your naval record and applicable statutes, re ulations and policies. In addition, the Board considered the advisory opinion furnished by NPC memorandum 1780 Pers 675 of 27 February 006, a copy of which is attached.

After carefu and conscientious consideration of the entire record, the Board fo nd that the evidence submitted was insufficient to establish th existence of probable material error or injustice. In this connecton, the Board substantially concurred with the comments contained in the advisory opinion. Accordingly, your application has been denied. The names and votes of the members of the panel will be furnished up n request.

It is regret ed that the circumstances of your case are such that favorable ac ion cannot be taken. You are entitled to have the Board reconsider i s decision upon submission of new and material evidence or other mat er not previously considered by the Board. In this regard, it i important to keep in mind that a presumption of regularity a taches to all official records. Consequently, when applying for a correction of an official naval record, the burden is on the appli ant to demonstrate the existence of probable material error or inj stice.

1. The following is provided in response to reference (a) Recommend denial o reques to enroll in the Montgomery GI Bill (MG ) Program. indicates she wasn’t told her enrollment election was a one time offer. The Statement of Disenrollment on a DD Form 2366 states the ember will not be able to enroll at a later date. Since
did not provide substantial evidence to support her claim of misinformation, there is insufficient reason to recommend approval of her request. A review of digital record indicates she disenrolled from the MOlE Program on 1 October 1998. Per reference (b), the decision to disenroll is irrevocable.
