DEPARTMENT OF THE NAVY

BOARD FOR CORRECTION OF NAVAL RECORDS

2 NAVY ANNEX

WASHINGTON DC 20370-5100

TRG
Docket No:
28 January 2002

10858-02

This is in reference to your application,
December 2002.

’

DD Form 149, dated 24

You contended in your application that because your initial
request to be discharged on 1 January 2003 and your request to
resign your commission effective 1 February 2003 were not
processed in a timely manner you will not be discharged until 1
March 2003.
You were concerned that because of this delay you
will be caught in a stop loss situation and may be recalled to
active duty.
action to discharge you effective 1 January or, in the
alternative, on or before 1 February 2003.

Therefore, you requested that the Board take

The stop loss message is dated 7 January 2003 and precluded the
discharge of officers with an approved separation date after 15
January 2003.
Since your formal request to be discharged on 1
February 2003 is controlling, you became subject to the stop
loss even if your 1 February 2003 date had been approved.
Therefore, on 14 January 2003, the Board denied your request for
a change in the discharge date.

Subsequently, you informed the examiner assigned to your case
that Headquarters Marine Corps had expedited your discharge
request and has discharged you effective 14 January 1993.
you have been discharged,
required and your case is hereby closed administratively.

further action by the Board is not

Since

Sincerely,

W. DEAN PFEIFFER
Executive Director
