Pursuant to the provisions of reference (a), Petitioner, a

commissioned officer in the Marine Corps Reserve, filed an
application with this Board requesting that his record be
corrected to allow him the opportunity to earn reserve
retirement.

to Petitioner's allegations of error and injustice, finds as
follows:

Before applying to this Board, Petitioner exhausted all

administrative remedies available under existing law and
regulations within the Department of the Navy.

Although it appears that Petitioner's application was

not filed in a timely manner,

commissioned in the Marine Corps Reserve on 17 December 1982 and
served on active duty until 15 September 1986.

Upon review and consideration of all the evidence of record the
Board concludes that Petitioner's request warrants favorable
action due in large part to Petitioner's excellent record and the

him out of the Marine Corps Reserve without the opportunity to
