1. Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner,
filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be
corrected to reflect entry grade credit for her dietetic internship. She specifically requested
that her ensign date of rank be changed to 7 April 1999. Her current ensign date of rank is
7 January 2000.
2. The Board, consisting of Messrs. Harrison and Schultz and Ms. Moidel, reviewed
Petitioner’s allegations of error and injustice on 25 October 2001, and pursuant to its
regulations, determined that the corrective action indicated below should be taken on the
available evidence of record. Documentary material considered by the Board consisted of the
enclosures, naval records, and applicable statutes, regulations and policies.
3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations
of error and injustice, finds as follows:
a. Before applying to this Board, Petitioner exhausted all administrative remedies
available under existing law and regulations within the Department of the Navy.
b.
In correspondence attached as enclosure
(2), the Chief, Bureau of Medicine and
Surgery office with cognizance over the subject matter of this case has commented to the
effect that Petitioner’s request has merit and warrants favorable action.
CONCLUSION:
Upon review and consideration of all the evidence of record, and especially in light of the
contents of enclosure
following corrective action.
(2), the Board finds the existence of an injustice warranting the
RECOMMENDATION:
a. That Petitioner ’s naval record be corrected, where appropriate, to show the date of
rank on her commission as an ensign, Medical Service Corps, U. S. Naval Reserve as
7 April 1999, vice 7 January 2000; and that her lineal precedence be adjusted accordingly.
b.
If Petitioner is qualified in all other respects, that appropriate action be taken to
effect her promotion to lieutenant junior grade in light of her corrected ensign date of rank.
c. That any material or entries inconsistent with the Board
corrected, removed or completely expunged from Petitioner
or material be added to the record in the future.
