BOARD FOR CORRECTION OF MILITARY RECORDS

Application for the Correction of
the Coast Guard Record of:

XXXXXXXXXXXXX
XXXXXXXXXXXXX

FINAL DECISION
BCMR Docket No. 2009-200

SUMMARY OF THE RECORD

The applicant asked the Board to correct the effective date on his November 17, 2005 13-month
extension agreement from November 17, 2005 to July 27, 2008. With the corrected effective date, the
applicant’s enlistment expired on August 26, 2009. The applicant reenlisted on June 3, 2009, for 72
months and believed that the erroneous effective date on his 2005 extension agreement would somehow
affect his entitlement to a Zone A selective reenlistment bonus (SRB) based on his 2009 reenlistment.

The Judge Advocate General (JAG) of the Coast Guard found that the effective date on the
applicant’s November 17, 2005 extension agreement is erroneous and should be corrected. The JAG also
recommended that the Coast Guard process the applicant for a Zone A SRB as a result of his June 3,
2009 reenlistment. The applicant indicated his agreement with the advisory opinion.

FINDINGS AND CONCLUSIONS

The Board agrees with the JAG that the effective date on the November 17, 2005 13-month
extension agreement is erroneous and should be corrected. The applicant enlisted in the Coast Guard for
four years on July 27, 2004. His end of enlistment was July 26, 2008. He extended his enlistment for 13
months on November 17, 2005. Therefore, the operative date (effective date) of the extension was July
27, 2008, which is the date the applicant began serving under the extended agreement. The Board also
agrees with the JAG that, if it has not already done so, the Coast Guard should process the applicant for a
Zone “A” SRB under ALCOST 286/08 as a result of his June 3, 2009 reenlistment.

ORDER

The military record of XXXXXXXXXXXX, USCG, shall be corrected to show July 27, 2008, as
the operative date for his 13-month extension dated November 17, 2005. Further, if it has not already
done so, the Coast Guard shall pay him a Zone A SRB pursuant to ALCOAST 286/08 as a result of his
June 3, 2009 reenlistment.

Coast Guard members who have at least 21 months but no more than 6 years of active duty service are in “Zone A,” while those who have more than 6 but less than 10 years of active duty service are in “Zone B.” Members may not receive more than one SRB per zone. The JAG argued that the applicant was eligible only for a Zone B SRB because he had completed more than seven years of active duty when he reenlisted, and pursuant to Article 3.C.4.b.3. The JAG recommended that the Board deny relief, arguing that the applicant was not eligible for an SRB because he did not complete 17 months of continuous active duty prior to signing the contract, and because his June 28, 2009, contract was an enlistment, rather than a reenlistment since he had not served more than 12 months on extended active duty. However, the applicant was not eligible for an SRB for integrating into the regular Coast Guard on June 28, 2009, for two reasons: First, he...
