1. The applicant requests his under other than honorable conditions discharge be upgraded to general, under honorable conditions.
2. The applicant states, in effect, he was told by a doctor to continue to work. However, his ankle still cracks when he walks and it becomes painful at times.

SUMMARY OF SERVICE:
The record shows the applicant enlisted in the Regular Army on 2 January 1996 for a period of 4 years. He was 20 years old and a high school graduate. He was trained in and awarded military occupational specialty (MOS) 88M10, Motor Transport Operator. His record documents no acts of valor or significant achievement.
SEPARATION FACTS AND CIRCUMSTANCES:
1. The applicants disciplinary history includes accrual of 30 days of time lost for being AWOL according to the DA Form 4187 in the applicants record between 14 August 1998 until he surrendered to the military authorities at Fort Benning, GA on 12 September 1998.
2. The applicants record is void of the specific facts and circumstances concerning the events which led to the discharge from the Army. The record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty), which was not authenticated by the applicants signature. He was discharged as a PVT/E-1.
3. The DD Form 214 indicates the applicant was discharged under the provisions of Chapter 10, AR 635-200, in lieu of trial by court-martial, with a characterization of service of under other than honorable conditions. The DD Form 214 shows a Separation Program Designator (SPD) code of KFS and a reentry (RE) code of 3.
4. The applicants record shows a period of unauthorized absence (AWOL) from 14 August 1998 until 12 September 1998 for 30 days. The record also shows a period of excess leave from 22 September 1998 until 15 November 1999 for a total of 420 days.
5. The applicant was separated under Orders 314-0190, DA, HQS, US Army Armor Center, Fort Knox, KY, with an effective date of 15 November 1999.
6. On 15 November 1999, the applicant was discharged accordingly. The DD Form 214 (Report of Separation from Active Duty) he was issued shows he completed 3 years, 9 months and 14 days of creditable active military service and accrued 30 days of time lost due to being AWOL.

EVIDENCE SUBMITTED BY THE APPLICANT:
The applicant provided a DD Form 293 dated 13 November 2012, DD Form 214 for the period of service under review.
POST-SERVICE ACTIVITY:

REGULATORY AUTHORITY:
1. Army Regulation 635-200 (Personnel Separations) sets forth the basic authority for the separation of enlisted personnel. Chapter 10 provides that a member who has committed an offense or offenses for which the authorized punishment includes a punitive discharge may submit a request for discharge in lieu of trial by court-martial. The request may be submitted at any time after charges have been preferred and must include the individual's admission of guilt. Although an honorable or general discharge is authorized, a discharge UOTHC is normally considered appropriate.
2. Paragraph 3-7a provides that an honorable discharge is a separation with honor and entitles the recipient to benefits provided by law. The honorable characterization is appropriate when the quality of the member's service generally has met the standards of acceptable conduct and performance of duty for Army personnel or is otherwise so meritorious that any other characterization would be clearly inappropriate.
3. Paragraph 3-7b provides that a general discharge is a separation from the Army under honorable conditions. When authorized, it is issued to a Soldier whose military record is satisfactory but not sufficiently meritorious to warrant an honorable discharge.
DISCUSSION AND RECOMMENDATION:
1. The applicants request for an upgrade of his characterization of service to general, under honorable conditions was carefully considered.
2. The applicants record is void of the specific facts and circumstances concerning the events which led to his discharge from the Army. However, the record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty), which was not authenticated by the applicant's signature. This document identifies the reason and characterization of the discharge. Barring evidence to the contrary, it appears all requirements of law and regulation were met and the rights of the applicant were fully protected throughout the separation process.
3. The applicant's contentions were carefully considered. However, there is insufficient evidence available in the official record to make a determination upon the applicant's quality of service. Moreover, there is a presumption of regularity in the conduct of governmental affairs. This presumption is applied in all Army discharge reviews unless there is substantial credible evidence to rebut the presumption. There is no evidence in the record, nor has the applicant produced any evidence, to support a change to the characterization of service granted. The applicants statements alone do not overcome the presumption of government regularity in this case and the application contains no documentation or further evidence in support of this request for an upgrade of the discharge.
4. If the applicant desires a personal appearance, it is his responsibility to meet the burden of proof since the evidence is not available in the official record. The applicant will need to provide the appropriate documents or other evidence (i.e., discharge packet) sufficient to explain the facts, circumstances, and reasons underlying the separation action, for the Board's consideration.
5. Therefore, based on the available evidence and the presumption of government regularity, it appears the reason for discharge and the characterization of service are both proper and equitable, thus recommend the Board deny relief.
