Issues: The applicant states: "I am requesting that you please update my decorations in section 13 of DD Form 214. (add ARCOM and ARCOM 'V'). I have included the signed orders for these awards I was given. Also, please consider changing my separation to an honorable discharge and or change my narrative reason away from misconduct. I have recently tried to re-enlist and have been unable to do so. I was discharged for being AWOL to visit a dieing family member that I was denied leave for due to the fact he was not considered immediate family. He passed within a few days and after the funeral I turned myself back in to my duty station on my own accord. I was demoted one rank, completed all my disciplinary duties, and was discharged shortly after. I was told that I had been a good soldier by the MSG in rear detachment and he was sorry that it happened in the manner that it did. I am hoping that the attached documents show my exemplary service and that you forgive for me leaving to see my ill grandfather. I was very close with him and did not want to miss seeing him once more before he passed. I feel I served my country honorably and would like my DD214 to reflect that. I also cannot re-enlist due to the misconduct narrative and would like to serve my country once again. I very much appreciate any consideration you can give to my request."

VI. Facts, Circumstances, and Legal Basis for Separation
a. Facts and Circumstances:
The evidence of record shows that on 18 March 2004, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 14, paragraph 14-12c, AR 635-200, by reason of misconductcommission of a serious offense for being absent without leave ((040126-040223) for which he received an Article 15, with a general, under honorable conditions discharge. He was advised of his rights.
The applicant consulted with legal counsel, was advised of the impact of the discharge action, and did not submit a statement in his own behalf. The unit commander subsequently recommended separation from the Army and waiver of further rehabilitative efforts. The intermediate commander reviewed the proposed elimination action and recommended approval with a general, under honorable conditions discharge.
The separation authority waived further rehabilitative efforts and directed the applicants discharge with a characterization of service of general, under honorable conditions.
b. Legal Basis for Separation:
Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 14 of this regulation establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, and commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, however, a general, under honorable conditions or an honorable discharge may be granted.
c. Response to Issues, Recommendation and Rationale:
After a careful review of all the applicants military records, and the issues and documents submitted with the application, the analyst found no mitigating factors which would merit an upgrade of the applicant's discharge.
The analyst determined that the applicants discharge was appropriate because the quality of his service was not consistent with the Army's standards for acceptable personal conduct and performance of duty by military personnel. By his misconduct (AWOL), the applicant diminished the quality of his service below that meriting a fully honorable discharge.
The applicant provided no independent corroborating evidence demonstrating that either the command's action was erroneous or that the applicants service mitigated the misconduct or poor duty performance.
The applicant contends that he was denied leave after being notified of a death in his family. However, there is a presumption of regularity in the conduct of governmental affairs that shall be applied in any review unless there is substantial credible evidence to rebut the presumption. The applicant bears the burden of overcoming this presumption through the presentation of substantial and credible evidence to support his issue. There is no evidence in the record, nor has the applicant produced any evidence, to support the contention that he was unjustly denied leave after being told of a death in the family. In fact, the applicants Articles 15 for being AWOL and other negative counseling statements justify the characterization of service granted. The applicants statements alone do not overcome the governments presumption of regularity and he has not provided any documentation or further evidence in support of his request for an upgrade of his discharge.
The applicant contends that the narrative reason for his discharge should be changed. However, the applicant was separated under the provisions of Chapter 14, paragraph 14-12c, AR 635-200 with a general, under honorable conditions discharge. The narrative reason specified by Army Regulations for a discharge under this paragraph is "Misconduct," and the separation code is "JKQ." Army Regulation 635-5, Separation Documents, governs preparation of the DD Form 214 and dictates that entry of the narrative reason for separation, entered in block 28 and separation code, entered in block 26 of the form, will be entered exactly as listed in tables 2-2 or 2-3 of AR 635-5-1, Separation Program Designator (SPD) Codes. The regulation further stipulates that no deviation is authorized. There is no provision for any other reason to be entered under this regulation.
Further, at the time of discharge the applicant was appropriately assigned a reentry eligibility (RE) code of 3. If the applicant wants to serve again, he should contact the local recruiter to determine his eligibility to reenlist. Those individuals can best advise a former service member as to the needs of the Army at the time, and are required to process waivers of reentry eligibility (RE) codes if appropriate.
Additionally, the analyst noted the applicant's issue about his awards; however, the correction the applicant requests to be made to the DD Form 214, does not fall within the purview of this Board. The applicant may apply to the Army Board for Correction of Military Records (ABCMR), utilizing the enclosed DD Form 149 regarding this matter. A DD Form 149 may also be obtained from a Veterans' Service Organization or online.
Therefore, the analyst determined the reason for discharge and the characterization of service were both proper and equitable and recommends to the Board to deny relief.
