Issues: The applicant states: "I am requesting to have my discharge upgraded from other than honorable to honorable.  I am trying to apply for veterans benefits, due to today's tough economy I am unable to provide myself medical benefits.  My time in the Army was rough and I would not have committed the offense of going AWOL, if it was not for my Company Commander trying to court marshal me, for a fire accident that happened one evening while I was on charge of quarters.  I had noticed a fire behind one of our washing machines and put the fire out and contacted the fire department to insure the fire was out all the way.  The result of the fire came from a cigarette that had been dropped behind the washing machine from a soldier passing by.  My company commander had accused me of placing the cigarette behind the washing machine.  He court marshaled me and during the hearing I was found not guilty of the offense.  From that time on after the court marshal hearing I felt that my company commander had it out for me.  I do not agree with any Soldier going AWOL, however I had requested to be transfer to a new unit, however my request feel on deaf ears and was never granted.  I feel that the character of myself was tarnished after the court marshal hearing among my peers.  Your consideration for my request to upgrade my discharge status would greatly be appreciated.  I am look into furthering my education to better myself in the workforce and I do not want my future employer to not consider me for employment due to my military discharge status.  So again thank you for your time and consideration."

VI.  Facts, Circumstances, and Legal Basis for Separation

       a.  Facts and Circumstances:
       The evidence of record shows that on 25 September 2000, the applicant was charged with AWOL (000613-000918). On 25 September 2000, the applicant consulted with legal counsel and voluntarily requested, in writing, discharge under the provisions of Chapter 10, AR 635-200 in lieu of trial by court-martial.  In this request, the applicant admitted guilt to the offense, or a lesser-included offense.
       
       Further, the applicant indicated that he understood that he could receive an under other than honorable conditions discharge and that the discharge would have a significant effect on eligibility for veteran’s benefits.  The applicant did not submit a statement in his own behalf.  The unit commander recommended approval of an under other than honorable conditions discharge.  
       
       On 11 December 2001, the separation authority approved the discharge with an under other than honorable conditions discharge.

       b.  Legal Basis for Separation:  
       Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel.  Chapter 10 of that regulation provides, in pertinent part, that a member who has committed an offense or offenses for which the authorized punishment includes a punitive discharge may submit a request for a discharge for the good of the service in lieu of trial by court-martial.  The request may be submitted at any time after charges have been preferred and must include the individual’s admission of guilt.  Army policy states that although an honorable or general discharge is authorized, a discharge under other than honorable conditions is normally considered appropriate.

       c.  Response to Issues, Recommendation and Rationale:  
       After a careful review of all the applicant’s military records during the period of enlistment under review, the documents, and the issues he submitted, the analyst found no mitigating factors that would merit an upgrade of the applicant's discharge.
       
       The evidence of record shows the applicant was charged with the commission of an offense punishable under the Uniform Code of Military Justice (UCMJ) with a punitive discharge.  The applicant consulted with defense counsel, and voluntarily in writing, requested separation from the Army in lieu of trial by court-martial.  In doing so, the applicant admitted guilt to the stipulated or lesser-included offenses under the UCMJ.  The analyst noted that all the requirements of law and regulation were met and the rights of the applicant were fully protected throughout the separation process.  It is also noted that the characterization of service for this type of discharge is normally under other than honorable conditions and that the applicant was aware of that prior to requesting discharge.
       
       The analyst noted the applicant's issues that he went AWOL because his Company Commander had tried to Court-Martial him and that he is looking into furthering his education and employment possibility.  However, the analyst determined that the applicant had many legitimate avenues through which to obtain assistance or relief, without committing the misconduct, which led to the separation action under review.
       
       Furthermore, the analyst found no evidence of arbitrary or capricious actions by the command.  The analyst was satisfied that all requirements of law and regulation were met and the rights of the applicant were fully protected throughout the separation process.  
       
       Eligibility for veteran's benefits to include educational benefits under the Montgomery GI Bill does not fall within the purview of the Army Discharge Review Board.  Accordingly, the applicant should contact a local office of the Department of Veterans Affairs for further assistance.
       
       
       
       
       
       Further, the Board does not grant relief solely for the purpose of gaining employment or enhancing employment opportunities.
       
       In view of the foregoing, the analyst determined the reason for discharge and the characterization of service, were both proper and equitable and recommends to the Board to deny relief.
