Issues: The applicant states: "According to my commander and first sargeant, when i was enlisted the correct action for failing a urinalysis was immediate discharge. I would have much rather taken the article 15 and served out the rest of my enlistment. Unfortunately that option was not available to me, and i watched as my friends and battle buddies, went to war without me. Although i do not condone the use of marijuana, i was young and made mistakes. Since then it seems as if the policy on drugs has changed. I have heard numerous stories of soldiers failing a urinalysis, but remaining in service. I feel a great sense of regret for the mistakes i made while enlisted, but would give anything to serve in the army again. I loved my job, and was destroyed when recieving information of my unit being attacked and my friends (like brothers) being injured. I realize the mistakes I have made, and have since then spent my time pursuing a life without drugs. I have enrolled in college, kept a clean legal record, and I have also sent my application in to become a state trooper. Unfortunately for me, my discharge will hold me back. I am requesting this review to upgrade my discharge for the sole purpose to better myself. I do not consider it to be a justification for the change of policy on drugs in the military, and my discharge. I appreciate the time and consideration in reviewing this matter. Thank you."

VI. Facts, Circumstances, and Legal Basis for Separation
a. Facts and Circumstances:
Evidence of record shows that on 11 October 2004, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 14, paragraph 14-12c, AR 635-200, by reason of misconductcommission of a serious offense for having wrongfully used marijuana between (040730 and 040830), with an under other than honorable conditions discharge.
He was advised of his rights. On 13 October 2004, the applicant consulted with legal counsel and voluntarily waived consideration of his case by an administrative separation board, contingent upon his receiving a characterization of service of no less favorable than general, under honorable conditions. The applicant submitted a statement in his own behalf which was not found in the available records. The unit commander subsequently recommended separation from the service and waiver of further rehabilitative efforts. The intermediate commander reviewed the proposed discharge action and recommended approval of the separation action with a general, under honorable conditions discharge. On 19 October 2004, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a characterization of service of general, under honorable conditions.

b. Legal Basis for Separation:
Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 14 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, and commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.
c. Response to Issues, Recommendation and Rationale:
After carefully examining the applicants record of service during the period of enlistment under review and the issues submitted with the application, the analyst determined that the discharge was both proper and equitable.
The analyst determined that the applicants discharge was appropriate because the quality of service was not consistent with the Army's standards for acceptable personal conduct and performance of duty by military personnel. The applicant, by violating the Army's policy not to possess or use illegal drugs, compromised the trust and confidence placed in a Soldier. The applicant, as a Soldier, had the duty to support and abide by the Army's drug policies. By abusing illegal drugs, the applicant knowingly risked a military career and diminished the quality of service below that meriting a fully honorable discharge.
The applicant contends that he was young and made mistakes and that he would give anything to serve in the Army again. However, the analyst noted that the applicant met entrance qualification standards to include age. There is no evidence that the applicant was any less mature than other Soldiers of the same age who successfully completed military service.
Furthermore, at the time of discharge the applicant was appropriately assigned a reentry eligibility (RE) code of 3. If reenlistment is desired, the applicant should contact the local recruiter to determine eligibility to reenlist. Those individuals can best advise a former service member as to the needs of the Army at the time, and are required to process waivers of reentry eligibility (RE) codes if appropriate.
Reference the applicant's issue of receiving an upgrade to better himself, the Board does not grant relief solely for the purpose of gaining employment or enhancing employment opportunities.
In view of the foregoing, the analyst determined that the characterization of service and reason for discharge were both proper and equitable, and recommends to the Board to deny relief.
