VI.  Facts, Circumstances, and Legal Basis for Separation

       a.  Facts and Circumstances:
       The evidence of record shows that on 9 July 2007, the applicant was notified of initiation of elimination proceedings under the provisions of Chapter 4, paragraph 4-2a(16), AR 600-8-24, by reason of substandard performance of duty for his failure to establish an adequate family care plan.  The applicant was directed to show cause for retention in the Army.  On 2 August 2007, the applicant submitted his resignation in lieu of elimination proceedings. On 19 March 2007, his command recommended involuntary separation from active duty under the provisions of paragraph 4-2a(16), AR 600-8-24.  The Army Ad Hoc Review Board recommended that the applicant’s request for resignation in lieu of elimination action be accepted with issuance of an honorable discharge.  
       The Deputy Assistant Secretary (Army Review Boards) approved the recommendation of the Army Ad Hoc Review Board and directed the applicant be discharged with a characterization of service of honorable.  

       b.  Legal Basis for Separation:  
       Army Regulation 600-8-24 sets forth the basic authority for officer transfers and discharges.  Chapter 4 outlines the policy and procedure for eliminating an officer from the Army for substandard performance of duty, misconduct, moral or professional dereliction, and in the interest of national security.  AR 635-5, Separation Documents, governs preparation of the DD Form 214 and dictates that entry of the narrative reason for separation, entered in block 28 of the form, will be entered exactly as listed in tables 2-2 or 2-3 of AR 635-5-1, Separation Program Designator (SPD) Codes.  The regulation further stipulates that no deviation is authorized.

       c.  Response to Issues, Recommendation and Rationale:  
       After a careful review of all the applicant’s military records, and  the issue, and documents he submitted, the analyst determined that the evidence was not sufficiently mitigating to warrant a change in the reason of the discharge under review.
       
       The applicant’s discharge was appropriate because the quality of his service was not consistent with the Army's standards for acceptable personal conduct and performance of duty by Army Officers.   The applicant provided no corroborating evidence demonstrating that either the command's action was erroneous or that the applicant’s service mitigated the misconduct or poor duty performance. 
        
       The applicant contends that his reason for discharge is inaccurate and that it is leaving him disadvantaged when seeking employment opportunities.  However, the applicant was discharged under the provisions of Chapter 4, paragraph 4-2a and 4-24a(1), AR 600-8-24, by reason of substandard performance with an honorable discharge.  The narrative reason specified by Army Regulations for a discharge under this paragraph is "Substandard Performance” and the separation code is "BHK."  Army Regulation 635-5, Separation Documents, governs preparation of the DD Form 214 and dictates that entry of the narrative reason for separation, entered in block 28 and separation code, entered in block 26 of the form, will be entered exactly as listed in tables 2-2 or 2-3 of AR 635-5-1, Separation Program Designator (SPD) Codes.  The regulation further stipulates that no deviation is authorized.  There is no provision for any other reason to be entered under this regulation.  Further, the Board does not grant relief solely for the purpose of gaining employment or enhancing employment opportunities.
