Facts and Circumstances: The evidence of record shows that on 9 February 2005, the applicant was notified of initiation of elimination proceedings under the provisions of Chapter 4, paragraph 4-2b(5), 4-2c(1), and 4-2c(4), AR 600-8-24, by reason of personal misconduct, nonjudicial punishment under Article 15 and receipt of a Relief for Cause Officer Evaluation Report. The applicant was directed to show cause for retention in the Army after fraternizing and engaging in sexual activity with an NCO (030601-040418), rendered a false official statement (040419), received a relief for cause OER (040507), received nonjudicial punishment under Article 15 (040914), and failed to provide child support as ordered by the civilian court (0409-0501). He was advised that he could submit a voluntary resignation in lieu of elimination or submit a rebuttal and request an appearance before a Board of Inquiry. The applicant elected to submit a voluntary resignation in lieu of elimination. The Ad Hoc Review Board recommended that the applicant’s request for resignation in lieu of elimination be accepted with issuance of a general, under honorable conditions discharge. On 30 June 2005, the Deputy Assistant Secretary (Army Review Boards) approved the recommendation of the Army Ad Hoc Review Board and directed that the applicant be discharged with a characterization of service of general, under honorable conditions. Response to Issues, Recommendation and Rationale: After a careful review of all the applicant’s military records, and the issue, and documents he submitted, the analyst determined that the evidence was not sufficiently mitigating to warrant an upgrade of the discharge under review. The applicant’s discharge was appropriate because the quality of his service was not consistent with the Army's standards for acceptable personal conduct and performance of duty by Army Officers. By his misconduct, the applicant diminished the quality of his service below that meriting a fully honorable or general, under honorable conditions discharge. The applicant provided no corroborating evidence demonstrating that either the command's action was erroneous or that the applicant’s service mitigated the misconduct or poor duty performance. The analyst noted the applicant's issue and determined that the applicant was discharged under the provisions of Chapter 4-2b and 4-24a(1), AR 600-8-24. The narrative reason specified by Army Regulations for a discharge under this paragraph is "Unacceptable Conduct", and the separation code is "BNC."
