      I certify that hereinafter is recorded the true and complete record
of the proceedings of the Army Board for Correction of Military Records in
the case of the above-named individual.  A quorum was present during the
further consideration and deliberation.  The findings appearing in
proceedings dated AR20050002369 were affirmed.  The following additional
findings, conclusions, and recommendations were adopted by the Board.

      The Board convened at the call of the Director on the above date to
reconsider the conclusions and recommendation appearing in proceedings
dated 20 October 2005.

      The Board considered the following additional evidence:

      Exhibit C – Human Resources Command (HRC) Memorandum, dated
17 May 2005, pertaining to the Record of Proceedings AR200500023659, dated
20 October 2005.










CONSIDERATION OF ADDITIONAL EVIDENCE:

4.  In January 2006, new information was received from Defense Finance and
Accounting Service (DFAS) officials indicating that HRC action had been
taken on the applicant that resulted in his reenlistment being antedated to
7 January 2005 for a period of 4 years, instead of the 3 years indicated in
the recommendation contained in Army Board for Correction of Military
Records (ABCMR), Record of Proceedings (Docket Number AR20050002369), dated

20 October 2005.

5.  On 17 May 2005, the Chief, Force Alignment Division, HRC, in a
memorandum to the Commander, 1st Battalion, 75th Ranger Regiment, Hunter
Army Airfield, Georgia, approved cancellation of the applicant’s 30
December 2004 reenlistment for a period of 3 years; and recommended
approval of antedating the applicant’s reenlistment to 7 January 2005 for a
period of 4 years.

6.  Based on the 17 May 2005 HRC memorandum, the applicant’s unit effected
an antedated reenlistment contract on the applicant that reenlisted him for
a period of 4 years on 7 January 2005.

ADDITIONAL DISCUSSION AND CONCLUSIONS:

3.  At the time of the decision of the ABCMR decision contained in Docket
Number AR20050002369, dated 20 October 2005, it was the intent of the ABCMR
to make the applicant’s record as administratively correct as it should
properly have been at the time.

4.  The ABCMR's decision in Docket Number AR20050002369 was based on the
information and recommendation contained in a 22 March 2005 HRC advisory
opinion provided to the Board, which recommended antedating the applicant’s
reenlistment to 7 January 2005 for a period of 3 years.  Subsequent HRC
action resulted in the applicant’s reenlistment being antedated to 7
January 2005 for a period of 4 years, instead of 3 years as originally
recommended.  As a result, implementation of the original Board
recommendation by the DFAS would result in a less favorable outcome for the
applicant.  Therefore, it would be unjust to implement the original Board
recommendation.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant
revocation of the original Board recommendation contained in ABCMR Docket
Number 20050002369, dated 20 October 2005, which will allow the antedated
reenlistment of 7 January 2005 for a period of 4 years already effected on
the applicant to remain in effect.
