      After careful review of your application, military records and all

a change in the character and/or reason of your discharge is denied.

      You may reapply to the Army Discharge Review Board for a personal
appearance hearing and/or you may apply to the Army Board for Correction of
Military Records.  Enclosed are the necessary applications for requesting a
review from both boards.  If you choose to apply to the Army Board for
Correction of Military Records you must do so within three years from the
date of this letter.

      Be advised that the Army Discharge Review Board operates on a 15-year
statute of limitations from the date of discharge; therefore, you must
reapply within this time frame for a hearing.

      If you believe that the decision in your case is unclear, not
responsive to the issues raised, or does not otherwise agree with the
decisional document requirements of DoD Directive 1332.28, you may submit a
complaint in accordance with Enclosure 5 of that Directive.  The complaint
procedure does not permit you to challenge the merits of the decision, but
is designed solely to ensure that the decisional document meets applicable
requirements for clarity and responsiveness.  You may obtain a copy of DoD

                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  Evidence of record shows that on 13 July 2000, DA, HQ, 3rd
Infantry Division (Mechanized) and Fort Stewart, Fort Stewart, Georgia,
Orders 195-0012 discharged the applicant from the Regular Army, effective
20 July 2000.  The record contains a properly constituted DD Form 214
(Certificate of Release or Discharge from Active Duty) which was
authenticated by the applicant.  His DD Form 214 indicates that he was
discharged under the provisions of Chapter 14, AR 635-200 by reason of
misconduct-patterns of misconduct, with a characterization of service of
general, under honorable conditions.  The specific facts and circumstances
pertaining to the applicant’s discharge are not contained in the available
records.

      b.  On 20 July 2000, the applicant was discharged.  At the time of
discharge, the applicant had completed 2 year and 8 days of active military
service and accrued 6 days of lost time in the period under review.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l4 establishes policy and prescribes procedures for separating
members for misconduct.  Specific categories include minor disciplinary
infractions, a pattern of misconduct, commission of a serious offense, to
include abuse of illegal drugs, convictions by civil authorities and
desertion or absence without leave.  Action will be taken to separate a
member for misconduct when it is clearly established that rehabilitation is
impractical or unlikely to succeed.  Army policy states that an under other
than honorable conditions discharge is normally considered appropriate, but
a general discharge under honorable conditions or an honorable discharge
may be granted.

        (2)  The issue is rejected.  The applicant’s record is void of
facts and circumstances concerning events that led to a discharge from the
Army.  The Board noted that the applicant’s record contains a properly
constituted DD Form 214 (Certificate of Release or Discharge from Active
Duty) which was authenticated by the applicant.  This document identifies
the reason and characterization of the discharge and the Board presumed
government regularity in the discharge process.  The applicant provided no
independent corroborating evidence demonstrating that the command’s action
was erroneous.  Individuals are assigned RE codes based on their service
records or the reason for discharge.  The applicant was appropriately
assigned an RE code of 3.  This Board found no bases upon which to change
the applicant’s reason for discharge because it was properly based upon his
record of misconduct during his tenure of service.  An RE Code of 3
indicates that the applicant requires a waiver prior to being allowed to
reenlist.  If the applicant desires to reenlist, he should contact the
local recruiter to determine his eligibility to reenlist.  Those
individuals can best advise a former service member as to the needs of the
Army at the time, and are required to process waivers of RE codes.   The
Board, being convinced that the reason for discharge and the
characterization of service were both proper and equitable, voted to deny
relief.
